The company in question paid out approx. $400.00 against my claim, so they made a half hearted attempt to settle what I believed to be a justified claim.

This firm, and several others solicit business through the mail, sometimes e-mails, offering warranty on older cars. I consider this to be mail fraud.

Approx. January (2007) I took out the "Policy" and when I attempted in July or August of that year tried to get them to live up to the policy met with only lack of action until they got a letter from an attorney.

It was virtually impossible to get through the 1-800 number in order to report a problem with the car. About 10 days after the first call someone finally showed up to check the engine which the company wanted "torn down" for inspection purposes. What if any client was miles away from home. They might have to wait 10 days or more after repeated attempts to get some attention from the company.

The mechanics felt I had a valid claim but Warranty America did not.

I obtained a copy of the "Policy" and had the mechanics check it over. They said it appeared to them that because of all the exclusions no one could make a "valid" claim for anything at any time.

Better Business Bureau in Colorado said this situation follows a pattern I guess a general pattern. They did not mention this company by name but they are in the same area.

I have copies of the correspondence re Warranty America with exception of the e-mails.

I had to rent a car at $752.46, plus interest paid as this was on a credit card...$68.52.

If any authorities wish to have copies of my letters for further investigation work I will be glad to send them.

I am the CFO of Warranty America. First off, let's clarify some facts that were mis-stated by "Nini":

1. We do NOT "solicit business" through the mail or any other way - our clients do. Those clients are the marketing companies and dealerships across the country.
2. I don't really understand the link to "mail fraud", but that is simply nonsense.
3. It's not at ALL "impossible to get through" to our phone lines, even though that is what your shop might LIKE you to think if they don't want to work with us.
4. I don't know what you are talking about when you say "wait 10 days".....??
5. The "mechanics" felt that you had a "valid claim"? You mean the mechanics that are right there in front of you competing for your business that have a vested interest in us paying them for the work on your vehicle - THOSE mechanics?
6. I find it amusing that a dealership would say that "no one" could make a valid claim under our contract when the fact of the matter is they don't want to work with us because will not allow them to charge you through the roof for repairs. Any customer should be happy to have us on their side - at least they will know they are getting a fair deal - or not.
7. BBB of CO never said anything of the kind about us. We are a member in GOOD standing and have been for years.

I notice you state you have "correspondence" with us. If that's true, and it's from an attorney like you said, then the correspondence would be from me because I handle those personally. Why don't you provide me with your contract number. I'm quite sure that letter would provide much more detail that you neglected to post here.

We are happy to review any situation and help anyone out. However, again - what is the reason for posting here? If there was a legitimate issue we would be dealing with it. The ONLY reason to post on here is to attempt to harm us in some way. Please consider that when reading these posts.
