I agree to purchased a warranty over the phone from (Sean Dietsch) of Warranty division, Lic on 1/28/09 on a 2002 Dodge Caravan for $1,750.00. A down payment of $195.00 was immediately withdrawn from my bank account. With the first payment of $86.39 due 2/10/09.

On 2/4/09 I called Sean and informed him that I wanted to cancel the contract, and I was told By Sean & Steve Dubiski his supervisor, that I should wait until I had received the written agreement and read it before canceling and if I still want to cancel to follow the instructions that were written in the contact for cancellation of the agreement. On 2/7/09 I received the written agreement, and it stated that I had a right to cancel at any time by written notice to the Administrator, Seller or Warranty Finance.

I sent written notice to Steve, at Warranty Division, Lic,2102 Pacific Ave. Bloomington, Ill. 61701 that I wanted to cancel the contract, and that I wanted my down payment of $195.00 returned. On 2/9/09 I called and talk to Steve and told him I still wanted to cancel the agreement and that I had sent a written notice stating this to him at the address provided. He advised me that I would receive written confirmation of the cancellation, and refund in the mail.

On 2/18/09 I check my bank account and notice that on 2/11/09 that Warranty Division had withdrawn $86.39 from my account. I called Sean immediately and was told by him very rudely. that my contract had been canceled, my down payment was non refundable, and I should receive $86.39 by 2/25/09.and that was the end of our business. I could not find anywhere in our agree where the down payment was non refundable.

I Steven J. Dubinski, sole owner of Warranty Division, LLC, personally overheard the referenced conversation and and took immediate action to resolve the issue with Mr. Smith upon it being brought to my attention. It is our standard practice to verbally disclose to every customer that the down payment towards every, and any policy is the sole possession of our agency and to be used and or refunded at our discretion. I personally witnessed and overheard Sean Dietsch doing exactly what he is supposed to do in disclosing the following information to the client during the referenced conversation. Later I received a letter from the client expressing his dissatisfaction with our services and immediately initiated a reversal of the transaction, otherwise against our standard practices but from a standpoint of customer satisfaction and quality of business. This should not deter any potential clients, but rather reconfirm our commitment to customer satisfaction, and give potential customers confidence in our ability to assist them with protecting their vehicles for years to come, as well as providing them with peace of mind. This reconfirms the philosophy here at Warranty Division, LLC that clients are not numbers, nor should they be treated as such, but rather they are the lifeblood that keeps our business alive and without them we would not exist. After consideration of the contract details that warranty Division and I agreed on, the company kept its agreement and refunded my down payment in full. Smith, Conroe, Texas U.S.A.
