The Shiawassee Condominium Association (Southfield, MI) through its attorney Jeffrey L. Vollmer (62728) who is associated with Wegner and Associates, P.C. (St. Clair Shores, MI) on November 02, 2010 foreclosed on Unit 108 addressed at 25340 Shiawassee Circle.  Under the Michigan law statue, MCL 600.3204, if a party foreclosing a mortgage by advertisement is not the original mortgagee, a record of chain shall [must] exist.  There is/was no existing chain of title prior to the date of sale, November 02, 2010.  J. P. Morgan Chase Bank, 1st lien holder NEVER assigned the mortgage to the Shiawassee Condominium Association (Southfield, MI) on or before November 02, 2010.  Laugh, Go ahead and laugh.  Laugh, laugh, laugh.  Sad to say, Jeffrey L. Vollmer is an attorney involved in Michigan condominiums and Michigan condominium law.  Sad to say, Wegner and Associates, P.C. (St. Clair Shores, MI) is a law firm that specializes in condominium law.  Michigan law statue MCL 559.208 (1) provides that a condominium assessment lien does not have priority over "sums unpaid on a first mortgage of record".  Jeffrey Vollmer should know this.  Wegner and Associates, P.C. (St. Clair Shores, MI) also should know this.  The Michigan Court of Appeal in Oakwood Park Association v Tracey Cathey, Case No. 08-093850 (Mich Ct. App, Dec 9, 2010) ruled that a lien assessment by a condominium association is subordinate to the previous filed mortgage of a mortgagee.  Unit 108 addressed at 25340 Shiawassee Circle yet belongs to J. P. Morgan Chase Bank not the Shiawassee Condominium Association.  The Michigan Court of Appeal has spoken.
