Complaint Review: America's Servicing Company

Well Fargo Bank Dba America's Servicing Company Purchased property 5/19/05. Loan transferred to ASC 10/13/05. Rc'vd letter by ASC claiming no flood ins. and they forced placed escrow acct. Now overcharging for twelve months although I have provided proof of insurance as well as my ins. agent. ASC attempting to forclose on property claiming late payments of $1504.98 per month, although my reg. pmt. only $883.14. ASC refuses to adjust account. Frederick Maryland

I signed mortgage contract May 19, 2005 with Freemont Mortgage Company. America's Servicing Company mailed notice dated 10/13/05 claiming mortgage loan had been transferreed and they were the new servicing company. ASC mailed notice dated 12/5/05 claiming my property had no evidence of any flood insurance and if I did not provide this information, an escrow account would be established. I faxed the information as well as my ins. agt.

Erie Insurance Company 12/9/05. ASC mailed information 2/27/06 showing they purchased flood insurance at my expense. Todate, for twelve months, I have recieved ten such policies that ASC has purchased, although I have continuously mailed, faxed, and phoned information to them to proove I have home insurance. ASC has increased my monthly mortgage payments to over 50% of my income, up to $1504.98 per month, have sent me forbearance plans based on the inaccuracies and improper applied payments, and have claimed forclosure of my property if I do not keep the forbearance agreements that I have never agreed to, or signed.

America's Servicing Company claims I owe two months payments of $2600 dollars and am reequired to pay $5,470.40 to get caught up with them, although I have been trying to make these payments, I have fallen behind, and am currently behind in every other bill I owe due to trying to pay my increased mortgage payments. I have fallen into deep debt and am facing
bankruptcy due to America's Sevicing Company.According to the Fair Debt Collections Practices Act, the America's Servicing Company has violated laws or policies by the improper applied payments and increased monthly mortgage payments and forebearance plans, based on ASC inaccuracies. America's Servicing Company refuses to adjust inaccuracies they made to my account or acknowledge any errors they have become aware of by my letters, and when I attempt to contact their legal department or loss mitigation department, I am told to mail or fax my complaints.

This company is a "ripp off", and truely needs to be investigated by the appropriate authorities such as the Office of the Comptroller, Federal Trade Commission, Department of Fair Employment and Housing, Office of the State Tresurury, and Congress and any others that would take an interest in this type of inappropriate aka BAD Business practices by Wells Fargo Bank dba America's Servicing Company and this company's methods to "steal" property from America's hard working class citizens.

I can only comment on the insurance issue. The correct fax number to send ASC your insurance info is 937-525-4100. If sent to any other number it will not be updated. Hope this helps.
