I, like many hundreds, if not thousands out there have fallen victim to Wells Fargo Auto Finance and their illegal practice of putting "forced placed insurance" (aka Balboa Insurance) on my account without reason/merit. I faxed proof that I had current insurance coverage and had never lapsed. I even had my insurance agent send it in several times only to be told that we needed to re-imburse Wells Fargo for the insurance that they put on the account before they would make any changes. They then applied my car payments to the insurance causing my account to reflect that I'm behind on my payments. A year and several months later, when I actually was late on payment for the very first time, Wells Fargo Auto Finance had my vehicle repossed (having only been late by 4 days- including the weekend!). Now, they are suing me for the difference of the money I still owed on the vehicle and the amount they auctioned it for.

It is my understanding that MANY people are out there in the EXACT same predicament and I would like to join in any class action lawsuit against this ridiculous game that they play! Please let me know if anyone begins one or at least knows of a good attorney willing to take such a case.

Thanks!

What many of you are at not taking in to consideration when signing your auto loans is the fine print. Wells Fargo Auto along with most other lending intuitions require you maintain full coverage at all times and if not insurance will be added to protect their asset (yes it is still the banks property until you pay the last note).  Also,  insurance is only added if you or your agent fails to add Wells Fargo as a lien holder, WFF insurance department was not aware of a switch in coverage and the most common for many clients, they have reduced coverage to liability to save on monthly insurance expanse. As for Wells Fargo repo practices, I currently work in the repossession department worked ever state and I can tell you that your complaint is untrue, full of wholes and sorry to say lies. It is Wells Fargo practice to not repossess a car unless it is 90 delq (which is 4 months not 4 days)  or above and if it is repo'ed at 4 days past due there are only 3 reasons:
1: the car as abandoned
2: the client request to surrender the car
3: you submited pmt in full on an account which was already out for repo and failed to inform Wells Fargo the payment was made.  I can tell you from experience, early or wrongful repossession is corrected within a 48hr period if Wells Fargo is in anyway at fault.

WFF was taking $229.0 from the $469.00 car payment and charging it towerds the forced insurance the were providing for the car. and I was never told about the Insurance they were charging me for. and at the same time I was insured through GICO ever sence i bought the car. and $469.0 was my regular car payment, but after they took the $229.0 every month and charged for there own insurance without me knowing. that made me late on every payment i had made for the past 7 months. after 7 months i was told to pay the past due amount of $3203.00 by monday if i want to keep my car. and this was on staurday. i borrowed money from frends and family and set up the wire through WM and because of the weekend the wire will go through by tuesday. and the same night they took my car and sold it in auction 10 days latter for $4000.00. and it was a $26000.0 dollar car. and now they want me to pay the rest in full.
they ruined my credit to the point where i can't even refinance my house. which is also finance through WF. this has turned my life upside down to the point where i feel like jumping off a bridge and ending this once it for all. but i have kids and wife which i have to care for. please let me know if you find a way to get these bullies.
