I've had an auto loan with Wells Fargo for about three years now (two to go). We've always been great about payments, sometimes a week late but always stayed in communication with them and they were generally very nice.

Last fall we moved and some things got confused, as things sometimes do. On December 6th I owed WF my payment for December and November, a total of $500 (my payment is $248/month). I took the call from the collector dude, got the Western Union information, and made my payment that day. About two weeks later some guy with a tow truck shows up outside my door wanting to collect my car. Luckily for me, a) it was in the garage and b) he was very nice and was happy to look at my Western Union receipt. He drove away without my car and I got on the phone with WF.

WF claimed they couldn't find my payment, even though I gave them the tracking # and all of the other information from the Western Union receipt. We eventually figured out that they had somehow credited it to the wrong account, so WF agreed to "investigate" the situation to ratify things. For the next week, I rec'd 5-6 phone calls a day. At first I was very nice, explaining to them that my account was being investigated for a missing payment. They always apologized and hung up. After the third day I started to get angry and demanded to speak to a supervisor.

The supervisor I spoke with had no clue what I was talking about and told me there was no record of any "investigation" on my account. I proceeded to give her all of the Western Union information - again - and she made the same promises regarding and "investigation." This time I made sure to call THEM 2-3 times daily to figure out what was happening. That got their attention, and the situation was worked out - kind of.

I was advised that the $500 payment had been applied to my account, however, they showed that I still owed $140. I asked them what for, and explained that I would flatly refuse to pay any late fees that had popped up after December 6th - as the error was theirs. The caller told me that they would conduct an "audit" on my account to determine the source of the fees. That was in January (after I made my payment on time). I continued to receive between 3 and 6 calls a day for the month of January.

I haven't made a payment since January, and I am now three months behind. I'm sure they would like to repo my car. Good luck - I'm currently out of the country on business and my car is in a storage facility in the vast jungle of the L.A. area. I told them that I would not be making any payments until they could explain the extra fees to me. One woman told me that she did not know what an "audit" was or how they could do one on my account. I don't really care any more, I'd just like to continue to spite them as much as humanly possible. But when I get back to the US I'm going to have to start sending certified letters, and I suppose make a few payments for what I do actually owe.

It's sounds like they really dropped the ball on your first encounter and you should not have had those late fees.....However, not paying them for the remainder of the loan is probably the worst idea in the world. Yes, it is true they won't be able to find your car, but what is going to happen is they will charge off your account and until it is paid in full you will have ABSOLUTEY NO CHANCE of ever getting another car loan. I am an underwriter for an auto finance company. I work in sub prime (people with bad credit) but paying late and charging off a car are two totally different things. Until you pay them in full nobody will give you a loan. Even if you do end up paying it off you will end up having to put 20% cash down and pay 21% on your next loan. Wells Fargo is a big company, your 20 grand car loan doesn't mean that much to them, but the extra interest you will have to pay for the next decade if you do pay off the charge off, will cost you thousands of extra dollars. Smooth move ex-lax.

It disturbs me, but doesn't surprise me to see this has been going on for quite some time. Once again, further proof that this is a systematic fraud.

These people must be stopped.... They will be

and to the person who said " just mail in the money...." if they can't post a payment correctly, why would you "just send them the money? " you think they are going to send it back if they ever decide they are wrong? NO . I was only able to have it returned for one person, and that was because we had the customers bank take it back. Do NOT allow them to automatically take it from your account. Don't allow automatic bills pay from your accounts by ANY company.

I you have a loan with Wells Fargo, do not bank with Wells fargo. It makes it harder for them to steal, and easier to get it back for you.

don't send them money you don't owe. If they dont credit your accounts for payments, ask them for a complete payment history, since day one, and ask for a copy of every statement they have ever sent you. compare them to the ones they have already sent you. They will not match. That is, if they ever send them.

In response to the rebuttal from
Britney - Catonsville, Maryland
U.S.A..

I have been a victim of the same practices by Wells Fargo Auto Finance. I pay my bill early and they don't credit my account, but call me asking for more money. Now they send letters because I sent them a "do not contact" notice certified mail, which is the only way to get this company to respond. I just want to say that what really "doesn't make sense" is why someone would pay more money to a company (that they would be current with if the company actually credited the payments to the account)when they obviously just take the payment and cash it without crediting any specific account for the payment.

Isn't that stealing? Isn't it harassment to continually call someone whose money you have misappropriated and ask for more? The person who wrote in originally is not to be intimidated by threats to ruin their credit. Kudos to you!!! Just because they loaned us money does not allow them to steal the payments we make to them.

Don't let them intimidate you. Why should you be? You made the payment and if it ever went to court, you have proof. Just look at the date the check cleared. WF cashed a check of mine 1/30/07 and did not apply it to my account til 4/5/07.

Currently, I have an online payment my bank says they received on 4/17/07 and it still is not reflected in my account and when I talk to them they say they have not received it. Chase Bank (my bank) says they did. Hmmm.

What they are counting on is for you to roll over and take it like Britney suggests you do. Don't be intimidated by this predatory lending company!

Why not pay what you owe while the $140 is being investigated? Don't you realize this is hurting your credit? Sorry, but you don't make much sense.
