Originated Loan Mod app back in 5/09, complied with every request by WF, documents/paystubs etc., Communicated by phone/email every week was advised that I could check my applications' progress anytime online at WF website www.wellsfargo.com/assist.

Daily updates indicated that my application was progressing. I had made it to step 3 (in process) pending an appropriate plan that would best suit my situation.

I phoned WF many times in between and was told that 'these things take time' and was assured that as soon as they were finished with my paperwork, they would contact me, either through US mail or by phone.

Imagine my shock when last Fri, July 24, while checking online, my application was 'Denied'. I spoke with Loss Mit dept this a.m. and the reason I was given for the denial was that I did not follow up with them by returning their phone calls. WHA? What phone calls?? If they did call, they never left a message or I certainly would have contacted them immediately. They have refused to reinstate my app and I was told that I must start the process all over again. Help! Possible to file class action on behalf of other borrowers? thanks

I'm not sure what you would be filing a lawsuit for. Your lender is under no obligation to refinance your mortgage. They can deny your request, its not illegal. I would just reapply, and make sure you are doing everything right. If you are really confused, go to an expert to help you with it.
