Our mortgage was transferred (sold) to Wells Fargo and subsequently serviced by Americas Servicing Company (ASC) in October 2005. We were not notified until October 13, 2005 that the loan was sold effective October 1, 2005. After struggling to get caught up because we too were told we did not have to make a payment for 60 days due to the sale we succeeded. I have mailed several payment that ASC has told they never received. The one payment was mailed December 21, 2005 from a Main post office branch. ASC has gone so far as to call me a liar. My husband and I have had several fights because this company keeps losing our payments. The payment mailed in December just now cleared my bank March 9, 2006. In January when the payment did not show up I paid my bank to STOP payment with the advice of the ASC agent. Little did I know this does not do any good. The stop payment only works if ASC submits the check, which they do not do. They do an electronic draft, which bypasses the stop payment function. Does the ASC agents know this? Of course they do. They are bargaining that you will reissue the payment preferrably over the phone where they can charge you an outrageous sum of $20 and then they put the check through. I have been told for the last 5 months they are working on getting web payments. If I took that long to do a job, I wouldn't have one. I too have left several messages for a supervisor to call me back. To date I have never received a call back. I have even considered calling the Better Business Bureau. Unfortunately, we were lied to and did not find out until too late that we have a 3 yr pre-payment penalty and cannot afford to refinance. Not to mention, we now have negative credit reporting because of ASC.
