Wells Fargo Wells Fargo Bank Mortgage Wells Fargo Obtained my SSN from my Ex-Husband, and ran my credit without my consent for a home refinance loan he was applying for. Wells Fargo then provided him with a copy. Phoenix Nationwide
On July 11th 2015 my divorce decree was signed by a judge making my divorce final. On July 30th 2015 my Ex- Husband walked into a Wells Fargo Branch to apply for a re-finance loan on his home. The original Loan for his home is through Wells Fargo in his name only. No where on the original loan, is my name, or any other idenitfying information pertaining to me. In the process for applying for a home re-finance my information was released to the loan manager and my credit report was run illegally without my consent or knowledge.
At no point did Wells Fargo reach out to me via telephone nor mail to advise me that my credit had been run a total of four times. Twice on 7/30/2015 and twice on 07/30/2015. On 8/1/2015 I received a credit alert letting me know knew inquiries had been placed on my credit. I called the credit reporting agency who informed me that Wells Fargo had requested all four inquiries on dates listed. On 8/3/2015 I contacted Wells Fargo and after being transferred from 5 different departments i reached Ron at the "Executive Complaint Level" Ron then told me he could not give me any information on the application becasue I was not listed on the apllication, but that he would assign an investigator to see why my credit had been run.
8/4/2015 I again reach out to Ron and leave a voicemail regarding my concerns. Ron never returns my call. I call again and speak to another representative by the name of Jerry. Jerry informs me of the investigators name, and that she left a voicemail for me. I ask to verify the contact number that they had on file as I had not received any calls, and the number they used to leave a voicemail was my Ex-Husbands Cell phone. Again I tell him my correct phone number and request for Kathy to return my call as soon as possible.
08/5/2015 I call and ask to speak directly to Kathy Weddle my investigator. She answers the line and asks if i received her call. I informed her she left a voicemail on my Ex-Husbands phone. She then takes my number (becasue Ron and Jerry did not note it in case) and explains she wil investigate how exactly my credit was ran and why.
On this day I recevied a text from my ex-husband. content of which divulges that he has had access to my credit report in detail, and he is aware of not only my credit score but outstanding debts and recent inquiries that have been made.
This is an illegal breach of privacy and a direct violation of the Fair Credit Reporting Act. Wells Fargo illegally ran my credit without my knowlege, nor consent, and did not notify me in writing or through verbal communication that they had obtained this information. At this point I have gotten no-where with Wells Fargo trying to resolve this issue, and can't remove the inquiries from my credit until I receive a letter from them stating it was their error. Please help me.

Based on what you wrote Wells Fargo doesn't even know who you were. So now think about what that means. Did you figure it out yet? Well let me help you.
You say that your information was released to the loan manager. Okay, so if your "ex" is in the bank applying for a loan, and the bank has no idea who you are, who do you think released it? Answer is of course your ex.
Now, you failed to say how it was released or exactly how it was used. However, if at any time your ex represented this information as his then he has committed Identity Theft and you need to immediatly go to your local police station and file a report. This would even include something such as him putting down your information and signing your name. If you are unwilling to do that, then unfortunatly you may not have much other recourse against either the bank or your ex.
If your husband represented it as his, or did something like "Let me take the forms and have her sign them", there would be no reason for them to contact you because they would again have no reason to suspect it. So if you haven't done so, you need to see what you can do to view the consent form that was signed in order for them to access your credit. They may have screwed up and hold some responsibility, but it looks like your bigger problem is your ex.
By the way....as a general comment. If your divorce decree was signed just a couple of weeks before your ex already knows a majority of your debt and credit situation because that is part of the disclosures each party is supposed to give. The only way he wouldn't is if you either failed to disclose them or ran up/paid down a significant amount in that period of time. As for your credit score...that is meaningless. The reason it is meaningless is because there are dozens of scoring models and it is really just a number based on the factors in your credit. So you could have a 700 with one and a 860 with another and they could mean the exact same thing.
