This is a realtor that agreed to be paid 3.5% commission if my property was sold through his agency which it was. He TOOK 4% and refuses to refund the rest of the money. He is also using my picture with my son's truck in it to resell it for his friend who ended up buying it from us. I have asked repeated times for our money to be returned and for him to use another picture to no avail.

We tried going through the BBB but they are of no use. They work for the business not the consumer. In my last contact with them Steve Wells claimed he was no longer using my picture so it wasn't an issue, only I checked his website and it is still there.

I forwarded the page to the BBB and heard nothing. I thought that would prove to them what a liar this guy is but I have heard nothing back. This guy is a crook, and uses crooked business practices.

You should check with the title company concerning the 4%. You should have received a copy of the settlement statement prior to closing. Were there any additional fees in your contract such as a transaction fee? A lot of times realtors charge this in addition to their commission. As far as the picture goes, the agent may have changed it in the multiple listing service but this does not automatically change it on his website. He has to manually go in and change it on his website. I don't think there is anything you can do about him using the picture. He took the picture and owns the right to it.

I am going to assume that a title/escrow company was used in your transaction? If so, then you need to call them as well because they are the ones who distribute the monies involved, including any commission checks to the realtor.


I would also take action in small claims court, it sounds like an open and shut case.
