Complaint Review: west lake financial services

west lake financial services PO box 54807 Los Angeles ca. I have paid my loan of on 7/3/13 I was told My Title would be mailed to me in two to three weeks sold my auto. I can not get paid for the reason I can not get A title from west lake they refuse to send it to me today is 8/10/13 I still can not get a response on when I will retrieve my title no one their can help me know one knows what is going on . please can someone help me get this co. I BOUGHT A CAR FROM A DEALER IN NEW JERSEY MY CREDIT WAS NOT TO GREAT THE DEALER GOT ME FINANCING FROM WEST LAKE FINANCIAL.  I PAID A VERY HIGH INTREST 24.9 RATE BUT I HAVE PAID OFF MY LOAN AS OF JULY 3RD 2013. SINCE THEN I HAVE SOLD THE CAR WITH OUT A TITLE I CAN NOT GET PAID INTIL I SIGN THE TITLE OVER TO THE BUYER. I WAS PROMISED THAT MY TITLE WOULD BE IN MY HANDS IN 2 TO 3 WEEKS FROM JULY 3RD.  SINCE AUGUST 1ST I HAVE BEEN ON THE PHONE WITH WEST LAKE AT LEAST 50 TIMES AND CAN NOT GET THEM TO SEND ME A TITLE. TODAY IS AUGAST 10TH, I STILL CAN NOT GET A RESPONCE FROM WEST LAKE. NO ONE THEIR CAN GET ME MY TITLE, NO ONE THEIR KNOWS WHAT IS GOING ON WITH MY TITLE. IS THIS LEGAL FOR THEM TO HOLD MY TITLE SO LONG AFTER THE LOAN HAS BEEN SATISFIED ? IS THEIR ANY ONE THAT CAN MAKE THEM BY LAW TO SEND ME MY TITLE IS THEIR ANY LEGAL ADVISE THAT I CAN GET FILE AGIANST WEST LAKE? HOW CAN I RESOLVE THIS AS SOON AS POSIBLE SO I CAN GET ANOTHER CAR TO GO TO WORK AGIAN ???  I DID GET A LETTER THANKING ME FOR PAYING OFF THE LOAN AND $300.  CREDIT ON A NEW LOAN FROM THEM. I WILL NEVER USE THEM AGIAN THEY ARE THE WORST CO. I HAVE EVER DELT WITH.

 If this is a crime I dont know but the dealer did not show any consern what so ever If the dealer is not conserned about doing something that is not legal should I be.?

- Of course the dealer isn't showing any concern..because they haven't given you one single dime, and if I read this they actually have posession of the car. 

The fact is the "crime" is more of a civil "crime".  In that you probably wouldn't go to jail or have any criminal charges against you.  But if the dealer decided to push it they could take you to CIVIL court where the court would effectivly void the contract and require you to give back all of the money(if you were actually paid).

As I said give it time..and since it hasn't seem like you checked with the DMV recently..perhaps another call to them may be in order.  At least to ask them if there are any requirements as for the amount of time they have to send it out.

In my case I did pay the loan off and it did clear from my bank on 7/3/13. I was promised by west lake it would take 2 to3 weeks at most to get to me. I should have recieved the title no later then 7/24/13. I have not changed address. I did give them onother 10 days before I became conserned. West lake did send me a letter stating it no longer hold a lean on my auto. I did go to the MDV with this letter and got turned away becuese it is not the policy of the DMV to accept a letter from no other then the lean holder directly.I did call west lake asked them to contact the DMV and they refused to do so. Spoke with their title dept. and no one would respond to why I did not have it as of yet was told it was released and in the mail as of 7/12/13 but no one knows why it was not mailed. Also not a single person that I spoke with has a clue on when it will be sent. I also sold the car to a dealer that was very aware of the west lake and did not show consern from what I gather the dealer did sell my car to some one else. If this is a crime I dont know but the dealer did not show any consern what so ever If the dealer is not conserned about doing something that is not legal should I be.??I have no knoledge of the title ware abouts west lake does not call me back I guess it will all hit the fan when the temp runs out on the  person that bought my auto and will not be able get it registered legaly with out a title signed by me. The dealer on the other hand will not release any money to me intil i give him a title signed by me.

 First of all regardless of if you "paid off" the vehicle or not..until you hold the title it is not legal for you to sell your vehicle.  So the finance company is NOT responsible for all of the sudden being required to rush to get you the title because you did this.

The main reason a finance company will hold the title is to make sure that the final payment cleared and won't "come back". You are dealing with a Sub-Prime lender who deal on a daily basis with people who have not shown they can handle credit, say one thing and do another, and yes send fraudlent checks/money orders and even cashiers checks.  So they will also probaly wait additional time to be sure.

However, with this said since states could have different laws, if you want to find out for sure if they have a specific amount of time they must release it the best place to contact is your DMV office.  Now, if you have moved it would most likley be the State where the title was originally issued and not your current one.  On that it is also possible since it is a different department if they send you the title it would be to the address that was on the title when you purchased the car..not your current one..again if you moved.

One other item.  In some States the lein holder just notifies the DMV electronically, and it is then up to you to go to the DMV and have the Title sent.  In other cases, they will notify the State but it could take the State an addtional 3-4 weeks to get you the title mailed if they do it automatically.  So again the best thing to do is contact your local DMV office directly to find out if by chance the title was already released.
