Vacation Stolen: We needed tickets for our Universal Studios Orlando vacation and someone(trips department) at our hotel referred us to Westgate. It would only take 90 min to view the presentation -NOT. We had our adult children with us: ages 17 and 25. We should have listened to them and not the Westgate Sales People.

Our objective was to decline every offer the presented, but time was of the essence since we wanted to tour Universal Studios with our kids. Everyone was hungry and frustrated and our kids even sat at the bar with a limo driver who had plenty of negative things to say about Westgate Sales People and how they will do anything/say anything to get you to buy a property.

Our salesperson told us about how he held his dying child in his arms and we felt so bad, true or NOT??? We had arrived at Westgate 9:30 AM. We didn't get out of there until 3:30 PM and with a purchase. Also, the Universal Tickets were not cheap. Westgate received $299 for them and a deposit for a purchase of our new ownership in a timeshare for $100. Thank God that is all the money we have into this;)

When we arrived at Universal Studios, it was to late to do any touring with my spouse and children. We had to wait in a ticket line because some woman had an argument with the clerk. We got one hour of Universal, but my spouse would not be able to return since we were there on government business for him. I would return only the next day with my kids and no spouse;(

Maybe they should have run our credit report. We had a Chapter 13 Bankruptcy in progress. We are not suppose to be able to take on ownership of any real estate. When we returned home, we consulted with our attorney about this and he recommended cancelling it. We contacted Westgate to cancel and explained our bankruptcy --they asked for proof of this statement made by our attorney; it was past the 14 day window for making cancellations. However, we just eliminated the bank account that they planned on making the withdrawals from.

Then, they started calling us and requesting their payments. We just eliminated the home phone number they had for us. We feel that we defaulted and only had $100 into this, so why don't they just leave us alone and resell our share? Instead they are threatening to report it to the credit bureaus. We really don't care if they do because our credit is not good anyhow.

However, what really is to report? We simply defaulted on an agreement later than the time window allowed; now leave us alone? It isn't like we requested our security deposit back.

So today we were contacted by email from Westgate. This is what they wrote: ******** Dear B****** Family,

Unfortunately, it has come to my attention that after numerous attempts; you still are not responding to our efforts to assist you with your Defaulted Account. It is not my nature to assume, however, if I do not receive a phone call from you by Friday, October 10 , 2008 at 3:00 P.M. (EST), I will, at that time, assume that you no longer are interested in our help. If you are having some kind of difficulty, I can help you. I want to help you. All you need to do is call me and let me know. Have a great day and I hope to hear from you soon. Happy to assist!!

So what are they happy to assist with is what I would like to know? My response to this email was ******What are you talking about? We don't have any dealings with Westgate. Leave us alone or I will have to contact my State's Attorney General.

Is there anyone out there that "didn't pay" Westgate and you are still being harassed? We were wondering how you handled it. We feel this agreement is broken because we couldn't own the property. It was not an allowable expense in our Bankruptcy Payments. We have gained nothing and they have gained nothing. We are even. They need to leave us alone and move on.

We would love to hear from others in like situations.

I fail to see where westgate ripped you off. they didn't MAKE you agree to purchase something. if you had been forthcoming about your bankruptcy then things woul dhave been different. As is you have now broken the law. The court won't care "that you didn't know" about not purchasing real estate.

Now you file this report because you are PROUD of ripping off westgate? You are a horrible person that ruins the economy for the rest of us

This person who filed bankruptcy is probably in a bad situation, but at least the company will probably never get a dime from them. This is what they get. I mean, it's like the credit card companies giving cards to college kids. You risk that you won't get your money in the end when you make a stupid investment. The only people who have a chance of buying a westgate property is people without a brain, or people who can't afford to take regular vacations and think Westgate is the solution. So if you want to gamble on these people with your high pressure sales tactics and 30 lies per minute, then you risk having uncollectable accounts. If you want people with a brain and good credit who pay their bills and can actually afford a timeshare, then you might want to change your tactics!

Hello, I used to work for this company and can tell you exactly what will happen. You being in a chapter 13 is NOT their responsibility, it is yours. Purchasing something on credit without court approval is a Federal Offense and depending on the nature can result in your bankruptcy termination and/or fine or jail term. It is considered fraud against the courts and is taken VERY seriously. Also, Westgate can and will file against you and a Foreclosure will be placed against you and be put upon your credit report. I know you're already in bankruptcy but a Foreclosure is still NOT a good thing to have following you around. I hope you get everything taken care of.

As I stated in our complaint, once we returned home from Orlando we consulted with our attorney Westgate Corporation Westgate Thinks We Are Still In a Deal even Though we Had a Chapter 13 Bankruptcy Orlando Florida

"When we returned home, we consulted with our attorney about this and he recommended canceling it." Therefore, it was only after we returned home that we learned that we could not own any real estate. Besides, people don't just go into agreements for free stuff (that is not free) Do you? I bet you have since it sounds like something you would do. And, further more, we are proud of our Chapter 13 Bankruptcy because we were ripped off by a Giant insurance company from no fault of our own. We would write and tell you all about it, but apparently you can't interpret written text because if you could, you would have been able to know that this discovery was made when we returned home. If you want to call the IRS you can do that too because my spouse is an Auditor for the federal government as well if you would like to speak to him. Now, get on with selling your properties and ripping off more people since you obviously have your work cut out for you. By the way, what is your line?

when you did not disclose that you where unable to purchase property and did it anyway in order to recieve a free gift or discounted gift. at that point you broke the law and are liable to the company because you signed a contract.the bankruptcy court might love to here from westgate. they would hold you liable. westgate nor its employs have anyway to know your personal problems. i am in sales at westgate smokey mountians resort and am very proud of the property i sell.( i realize it is not for everyone) but you are fussing to the world on the internet when you are the fool that tried to get something for nothing.(and commited fraud while you were doing it) real smart there folks. by the way my name is SCOTT WHITE so if you ever come to the smokeys for a vacation please e come for a tour at the resort and i will be happy to notify both the I.R.S. and the bankruptcy court in your home town on your behalf. we sell real estate ! do you think we were just playing at it? this is a billion dollar company and it did not get that way by not giving its owners what they expect (if not more). so the next time you deside to commite fraud and break every bankruptcy law in the USA i recomend that you dont post it online for all the world to see.
