I bought a 2001 Ford F150 in May, 2004 from Westport Auto Center. I also purchased a warranty from AUL Administrators for 36,000.00 mile/3 year coverage for $1,645.00 because the truck had 90,000.00. On August 25, 2004 ball bearings where shot and the clutch went out. The Ford dealership made the claim and AUL refused to pay for it. They would not even drive down to the shop to look at the ball bearings which are covered in my service contract all because the Technician used the word "worn". They didn't even verify it in person!! I called AUL asked why, and they told me they would only cover the part if it was defective. Isn't that fradulent to cover a truck with 90,000.00 miles when every part on it can be classified as wear and tear?

I then called Westport Auto Center to cancel my warranty and get the pro-rata refund that is due me if the contract is cancelled. Every time I called for Pat Moore (314) 429-5200, he was busy or away from the office. I left several messages and never received a return call. I now have a $1,031.00 credit card balance and got ripped on the warranty that cost $1,645.00.

I have documented every call and have coppies of my warranty, repair bills, cancellation letter, and odometer affidavit. Is this worth going to small claims court? Would I even have a chance? Can someone please contact me with legal advice!!

It would certainly be worth sueing the dealer for misleading you on the coverage they sold you and for not filing your refund promtly. Rarely does a contract cover bearings and contracts never cover clutches. The dealer should have told you the exclusions when you purchased the coverage. The dealer mislead you. You could read the exclusions portion and that would be clearly spelled out.

WHY IS WESTPORT AUTO CENTER TO BLAME?

It appears the Ford tech from the Ford store said the part was worn and worn parts are not covered how is that Westport Autoi Centers fault? If you did not get anyone to take or return your call like you said FROM WESTPORT AUTO CENTER why did you not go there in person to resolve the matter and cancle the warranty. You can call the warranty company which is provided with the paper work you signed and cancle the warranty. They would instruct the dealer to cancle the warranty on the spot. It sounds like your beef is with Ford if they did not diagnose your car properly which caused the warranty company not to pay. And as far as the warranty company coming to check every part a certified ASE mechanic has just daignosed as worn is a unreasonavble excepectation since the ford dealership would have bennifited if they got to perform the repair. This should be taken down and the ford dealership you dealt with should have there name in the place of Westport Auto Center!

I Also had trouble with AUL

I too have had difficulty with AUL. I cannot take it anymore and am taking legal action. If you paid that much for a warranty, you should be covered, but all AUL does is seperate you from your hard earned cash. I too have written a rippoff report. Definately contact your local court and start a suit.

AUL is expecting the regular Joe like you and me to just back off and give up. We need to stand our ground. We purchased this coverage as protection, not to get jerked around.

Good luck my friend.
