I just want to let everyone know about the Flip/Flop "Westport Homes, Inc." located in Houston Texas.

We negotiated on a under construction luxury home with a custom home builder Westport Homes, Inc.; seller accepted our terms (including a Change List) and offer; we signed the contract. A day later; seller called and said he would not do certain items from the Change List previously he accepted in writing. We complained but decided and agreed to remove some items from the Change List and signed new contract. Again, seller called days later and change the list again that was previously changed and accepted by him. We complained again and the next time he increased the price. His agent and I got frustrated but I increased my offer; the seller accepted our offer and agreed to do all items that were listed in the Change Item (many items were already removed) and we signed the contract again. On July 2,
2008; his agent personally delivered him the contract and the Change List (already accepted). The seller made more changes to the list; added extra cost to some of the items he previously agreed to (in writing via email). Again, we decided to forego the items he refused to do in the list; both parties signed and executed the contract on July 3, 2008. Their office was close on 4th, 5th, 6th, and 7th of July. I got a call on July 8th that the seller will not sell me the house unless I increase the offer. His agent mentioned to me today (July 11, 2008) that the seller (Westport) has asked her to terminate the contract.

Accurate Rebuttle to July 18, 2008 Complaint

#2REBUTTAL Owner of company

Tue, July 14, 2015

In respone to the complaint filed by an un-named individual in Katy Texas on July 18,2008 my comments are true, correct and can be supported by accurate contract documents Westport retains.

During 2008 this un-named person submitted a Purchase Contract for one of Westport's inventory homes located in Katy Texas.  Westport did not sign/accept the Purchase Contract based on the terms submitted and verbally communicated Westport's response via Westport's Sales Broker.  The communications did not meet the un-named purcharers desired terms at which point Westport DID NOT accept or agree to the purchasers terms and the sale did not conclude.  At no time did Westport sign Purchase Contract documents accepting purchasers terms originall submitted.  Westport has conducted business in Greater Houston since 1992 with the highest degree of professional courtesey, ethics and concern for all Westport clients.  Our reputation remains untarnished with the exception of this one eroneous complaint which is 100% inaccurate and a demonstration of negitive behaivior.  It is my opinion that the flow of information via the World Wide Web can be both instructive and destructive when improperly used.

Respectfully,

David Moore
