My wife and I went in to westside mitsubishi in late December 2010 and dealt with a salesman named chris hussein. He seemed to be a decent guy and we decided to purchase a 2009 endeavour from him for 27000 dollars which he assured us was a good price on a vehicle which they had received as a trade in.

Everything seemed to be going well until we were told that financing had been denied due to the fact that the 2009 endeavour was not listed in the black book and therefore would not be approved by any bank. i wondered how the previous owners had been able to obtain financing since no bank would touch this vehicle, and i decided to do a little bit of digging around.

I found out that legally the 2009 endeavour did not exist since all 2009's were just 2008's being called 09's by mitsubishi and had in fact all been owned by mitsubishi corporate. these rebranded 09's were nothing more than demos probably shitbagged by mitsubishi insiders and now being pawned off on an unsuspecting public. further, a search on autotrader.ca showed us that he had overcharged us by 3500 dollars compared to other dealerships in alberta.

we expressed our displeasure with what appeared to be sleazy tactics by this dealership but our slick little sales man assured us that he'd had no idea about the history of the endeavour and that we could trust him to find us something else. like idiots we put our faith in this d****e bag again, and again he screwed us over.

He ended up selling us a 2010 outlander which he assured us had been "safetied" despite what we showed him were bald tires on the front. We became suspicious of this nest of vipers and ran a carproof check on the vehicle only to find that it was an ex-rental car. We would never have had anything to do with a rental car bought at auction and would have walked away from the whole thing if only we had known the truth.

This is not about the issue reported but i am hoping someone might know where Rick Dyrland can be located or where he is working? He owes his children over $25,000 in child support payments. I've been trying to locate him for several years but the deadbeat d****e bag seems to have disappeared. If Rick Dyrland is willing to rip off his own children then he wouldn't have any problem ripping off anyone else. Sorry you had to go through this bs. Any information would greatly be appreciated. Just wanted to say thank you for your interest and advice. While everything you say is true I do feel I should add a couple of points:

A) Here in Alberta we have 2 pieces of legislation which protect consumers, the Far Trading Act and the Sale of Goods Act so it's not completely like the wild west atmosphere one might find in some american states. Perhaps if the US government worried less about "spreading democracy by cruise missile" and more about their own back yard this might change.

B) Anyone shopping for a used vehicle should invest in a small tape recorder and hidden microphone in addition to the car proof and other precautions. These items can be had for under $100 and will provide cheap insurance for years to come.

Just an update on our progress against the ripoff artists at westside mitsubishi.

I got into contact with a representative of the Royal Bank, Shawn Blakely, right from the start of this mess and informed him of the fraudulent circumstances under which we had signed the financing contract. Mr. Blakely put the funding of the contract on hold and instructed the bank to investigate it, which they did thoroughly enough to cancel it.

This is a huge victory for us in that the legal department of the Royal Bank saw right through the westside scammers and wanted nothing to do with this file, nor did they have any desire to be named as defendants in this case, as they surely would have been had they decided to aid or abet the thieves at westside mitsubishi in the furtherance of their offence. Due to the bank's wise decision, we now have only to recover our downpayment and the damages caused to us by the defendants rather than go after them for the payments we would have unjustly been forced to make.

I was in court on friday march 11, 2011 in order to have 5 of the 6 defendants noted in default for not filing their Dispute Notes within the 20 day period allowed by the rules of the court, but was unsuccessful. the court found instead that the Dispute Note filed by Rick Dyrland would count as filed on behalf of all the defendants and that a pre-trial conference would be scheduled.

I am looking forward to this hearing for several reasons, not least of which being the fact that their dispute note seems to have been written by a borderline retarded child. Not only is the hand writing and grammar on par with what one would expect from a stick boy for the oilers, but they countersue us for $50,000 because "we did absolutely nothing wrong but the customer has written very rude statements on the internet which hurts my personal reputation and the possible loss of business at westside mitsubishi".

This counterclaim is absolutely laughable due to the following reasons:

A) truth is an absolute defence to libel or slander,
 
B) the limit in small claims court is $25,000,

C) the small claims court lacks jurisdiction to hear actions for slander or libel so they will have to raise the case to the court of queen's bench,

D) it totally corroborates some of my most important points, while locking them into lies they won't be able to escape under cross examination
 
these guys had better get a lawyer and quick because at the rate they are going they are going to lose their shirts. this is especially true if they are stupid enough to take this case to the court of queen's bench where there is no cap on the amount of exemplary damages which may be awarded.

I also can't wait to see their faces when I make my motion for disclosure in this case since i'm going to be asking for the names of everyone to whom the yachimec group has sold ex rental vehicles or ex repossessions or vehicles bought at auction. if they refuse to do this i will be forced to rent a van and drive it around edmonton with a large decal on it imploring past westside mitsubishi customers to run car proof reports on their cars to see whether those reports disclose something different than was told to them by their slick little salesmen. 

i think this is one can of worms that will take a long time to close. ill keep you posted.

I sincerely hope you get out of this but it brings up some good lessons.

Please do your research BEFORE you agree to anything, not after.  Don't get your financing at the dealer, get your financing in place before you ever darken their door.  Don't give them a 2nd chance, if they are playing stupid car dealer games, walk out, they need you a lot worse than you need them.  Do not let them intimidate you at all.  If you don't feel confident, take someone with you who is familiar with the games.

Don't believe anything they tell you unless you double check it yourself.  They all lie. Never agree to anything without going home first to cool down and think about it carefully.  They will do everything in their power to keep you from doing this.  Do it anyway!

This morning (the next day after taking possession) we took the vehicle to canadian tire to have it inspected. they recommended 4 new tires and a wheel alignment as well as telling us that they found rust starting to form on the "flex sections" of the exhaust system. we phoned westside d****e bags and spoke to the head d****e Rick Dyrland and asked for our money back but he refused stating "i don't legally have to refund your money", and "how was i supposed to know it was an ex-rental vehicle", and "i don't have to tell you the vehicle's history". we also talked to d****e junior, the slick little salesman, and he told us that he had been fired over this, which was quite ironic seeing the snakes starting to turn on one another already. i guess there really is no honour amongst thieves LMFAO. we also contacted shawn blakely, edmonton area rep with royal bank and informed him of the fraudulent circumstances under which we had signed the financing contract. he assured us that the application had not yet been processed and that he would be putting it on hold pending an investigation by the bank. most satisfying of all we filed suit in small claims court against this cast of creeps and served 4 out of the six miscreants whose full names are
a) bart yachimec (served)
b) rick dyrland
c) chris hussein (served)
d) amelia keehn
e) maggie lim (served)
f) 965515 Alberta Ltd. operating as westside mitsubishi (served)
If youve been ripped off in a similar fashion by these scumbags contact me as we are trying to organize a class action suit as well as put pressure on the alberta government to bring in laws similar to ontario's to protect consumers from such scams.
