Complaint Review: WFAF # 5507 . WFFA

WFAF # 5507, WFFA Spanish/Bilingual employees at WFAF are discriminated. The company is biased and discriminates against employees of bilingual heritage. They also inflict emotional and psychological anguish to make the employee fold. Stay away! Chester Pennsylvania

My annual 2005 evaluation embedded content/ terminology prohibited by the ADA of 1990 (APA -DSM IV). Management ploted a strategically to make me seem an emotionally and psychologically impaired individual. Furthermore,they added connotations " sometimes when Gabe becomes passionate about a topic his judgment is overriden and reacts harshly"

Management was setting me up for termination and tarnishing my employee records. I refused to sign the evaluation ( Written on 01.30.2006. Presented on 02.07.2006 and after receiving counseling I submitted a written dispute in writing(Escalation)
They tricked me into entering my comments into the original annual evaluation. Then ammended the evaluation.

I held my ground. Two supervisors took me into an office cornering me to sign. I did not. Since it is hard to retain the services of a good employment lawyer ($$$$$) I esclated to Human Resources in the process only the ammended evaluation was submitted to HR Corp.(I was never given a copy of the ammended evaluation)

I held my dispute-which still stands because it was an overt violation of my civil rights under grounds of emotional and mental distress-which was true- These allegations scared me.

Without proper legal representation I held the matter under STD(Conflict of interest)- It was stated on an official letter submitted on 02.28.06 The impact this evaluation had on me.

Human Resources ommitted, mishandled, delayed, played psychological games to confuse the matter. They calimed never receiving the faxes and documents I submittes(90%) of the time.

I underwent a serious breakdown overexerting myself doing research, not sleping or eating. They delayed important paper work I requested for over a month request: 3.2.06/ mailed 3.28.06. They claimed mailing correspondence I never received. They changed my supervisor without notification.

Around April 14, 2006 I received a letter threatning termination due to the fact that I had not responded to a "prior sent letter" NEVER RECEIVED- From the Leave Process Dpt. I challenged it. For about three months they played games.

I was pre-approved for 2 weeks of STD and did not receive a penny until the 3rd week of May. Human Resources pretended I was on leave because I was sick or something-NOT because of the potential harm this evaluation could have caused me beyond termination to a frame up or incrimination. Otherwise why would they rush to ammend an evaluation completed 11 days prior to 02.10.06 in two hours ?

and why Instead of submitting both the original copy presented to me on 02.07.06 and the ammended evaluation. Only the ammended was submitted to HR Corp. I went through the motions of chain of command in spite of innuendoes made against my intelligence (Cognitive thinking processing) of disposessed
knowledge of how to proceed. A

t some point I even requested a truce and to be transfered. The HR liason responded after I requested to escalate the issue to the highest point. The highest authority, The Human Resources VP did not answer my claim from 15-16 days until I send an email threatning to communicate the information to the EEOC. I received a generic 3 clause email.

About 2 1/2 weeks later my dispute or mediation was denied by the HR VP. The HR VP attitude was pitiful. I have encountered more polite people at junk yards. She was nasty and sarcastic, as if stating with her tone and arrogance, "You are a worm and I am Queen Elizabeth" WFAF/WFFA 5507 refused a face to face- I have read extensively and my rights were violated-


I have a prima facie. The goal of the company was to terminate me and crush me, therefore I would had no legal recourse and my records were stained. They discriminate against Bilingual(Spanish-English speaking representatives in customer service-

They have 16 members of management as of Feb 10 06 only one handled Spanish escalated customer requests. Management talks a lot about diversity on cyberspace and handouts(Talk is cheap)

The Hispanic(Bilingual customer service representative works ith limited resources) and if -you- say something then you are labeled as a whinner. If you are Hispanic and have intentions to work for this company please make sure you read their At-Will employment agreement and the employee book guidelines.

Speaking Spanish in this company is a curse not a blessing and it affects you stats(numbers - I worked in Customer Service) It does not appear as a contribution to diversity and it dos hurt your Average Handle time scores - The pay no differential and they take for granted the complex work of Customer Service Reps-who handle complex calls in nature (As of february 10 of 2006)

As of 02.10.06 there were departmets. WFAF libeled me (Mor than one account) mentally and emotionally distrssed me with their ambiguos unjustified claims.

The Spanish only speaking customer is not a prioriy ( On ite departments Tiles, Total LOss and Redempioms did not have any Spanish speaking and the Latinamrcan employe)

Just be be aware the whopper add and the commerial are not the same thing.They use the bilingual employes. I have a pending dispute. Could dypu gve any advice. This matter requires great importaortance .if you are requesting explanations and management is 'interrupted' because they are going on vacation and are not willing to address your work related request you get a verbal warning..........An if you only knew what they do to the Spanish speaking customers. Soon I will disclose that through local or even national press.

Sorry, but being bilingual is not covered by Title VII. And from the looks of your report, you are not truly functionally literate in the English language, and you do overreact.

Not everyone is against people of latin heritage, despite your claims. It appears that your company had your history to fall back on to support their review of your work performance and behavior.

Don't be a victim; get educated, you use English fairly well, just get better. American business is done primarily in English - not Spanish - and your interpretive skills will be necessary, but only if you're really good at both languages.
