On May 7th I talked to Rick Davidson at 3:30pm. He stated He was going to put our phone call everywhere online for all my customers to see forever. That this is his law. That he is going to send the the police, a  federal agency after me file a small claims in CA. That I was doing tons of illegal activity by posting reviews online. When I said I would like to resolve this matter and take down my reviews if He gives us back our $298.00 and cancels our contract. He said I was bribing him. That I was scum and he is going to ignore that I would stop to that level. That It was illegal for me to even ask that. He said I have low morals He sees people like me on the side of the freeway everyday. That I was part the topic of an hour and a half meeting last Thursday with 150 people.

It all started when I received a phone call in November of 2012. The gentleman calling claimed he was with the Google Company. He told me that by receiving his phone call,  I could pay $150.00 to be on the front page of Google. I was excited and told him that Google is an amazing company with marketing opportunities for our small business. I had placed many businesses ads on Google previously but was under the impression that Google does not allow you to pay to be on their front page. I asked him about this and was assured that it was possible but only with his (this) phone call. I told him my Husband and I were very interested. However, our small business is seasonal and was about to shut down for the winter. I asked if I could save his number and call for the same opportunity in the spring. He replied that he was not certain we could still get on Google in the spring, but to call back and try. Being on the front page of Google sounded like a great opportunity for us, so when March rolled around I told my Husband to call. My husband called and started the sign up process with whom he believed to be Google. My husband said that while signing him up for the Google deal they told him the department was called EGumball. The price had also changed to $298.00 with a year contract of $150.00. They told my husband that our business would be advertised everywhere online (Google, Bing, ). While signing up my husband Nate told the sales rep we do not accept 800 numbers and we would have to call them back to finalize our setup as we needed to provide additional information for the setup process. The sales rep assured him that was fine. My husband had not provided a location at that time. We park our trucks in a lot and needed to locate an address being that our lot has no physical mailing address. My husband Nate called back a few days later to provide Google/Egumball with a business address. Google/Egumball explained that the next step was a post card from Google and Bing. He thanked them, hung up and we waited for the post card which never arrived.

 On April 10th I called myself and spoke with Elaine. Elaine was very rude and uncooperative. She explained that Tiffany (myself) can not talk on behalf of this account because I am not on the contract. I told her I understood and prefer not to be added. To proceed with the conversation and discuss the contract, I called my husband Nate on three way. Elaine would not allow either myself or Nate to speak much at all. She stated that everything was our fault because they had not been able to call and verify our business. Nate told her that he had informed them during sign up that we do not accept 800 numbers on our business line. He also explained that he had been told to call back and had done so. He informed Elaine that we were now waiting on the next step, the post card from Google and Bing. Elaine talked over us saying repeatedly that "it does not matter because we have a contract and need to pay."  Nate asked to talk to her manger she said she "would put in for a ticket with Josh to call us back". She said Josh would call us in 24 to 48 hours. We are still waiting for his call. Nate also asked her why their company had taken our money before finalizing the setup and working out the details? Elaine said that we have received their services by talking to her on the phone and emails. She kept putting us on hold and hanging up on us during this conversation. When the call finally ended, I did some research on Egumball. What I found online was appalling to me. There were many complaints, negative feedback, and even customers talking about taking them to court for similar issues. It seems they call claiming to be Google and take your money without providing any services at all.

On April 26th Nate and I called again to attempt to receive services and or resolve our issues. We spoke with Kate who at 10:33 am hung up on Nate & I. We called back and she said she had personally called us previously and "some women had answered and hung up on her". I am certain that this did not happen. It is a rare occasion that I ever answer the phones and everyone else involved in our business is male. So once again, I find this company lying to me. My husband Nate also has never received a phone call from her. Kate told us that they never said they were google to look at our contract I told her that I would love to but have not received anything from EGumball. She told us she can not send another contract or talk to us about it until it is brought out of collections. She gave me the name of the collection agency as Caine & Weiner.

After speaking with Kate, I called the collection agency Caine & Weiner. They had no records of Nates account. I called Kate back and told her I was trying to do my own mediation and I was willing to pay her the $298.00 for services we never received and end our agreement with EGumball. I told her that I no longer trust or wish to do business with them. I told her that I do not feel that I should be liable for a contract I have never seen and if it does exist I believe they they broke the "contract" first by not listing our business online in 30 days as promised. Kate said no to my offer and assured me that I can not go through Utah resolution. She said I have to go through american arbitration association as stated in our contract.  She told me our contract also states that if I want to go to small claims that it will have to be in the state of California. . I called CA courts but couldn't talk to anyone due to budget cuts. Kate also said she would wave the month of May if we paid that day. I have called the American Arbitration Association and they are very expensive. It would cost us $700.00 to start a case and another $1000.00 for paper work and fees. The entire contract with Egumball is less than this amount..

In the mean time, Utah resolution has clued and left several messages an a letter to EGumball with no response.

 I understand that my husband is the person listed on their contract. However he is a Police Officer, Small business owner and currently enrolled in collage full time. I do not need him worrying about or getting caught up in this scam. I would like to resolve it myself if possible.


I feel this business should be shut down and that they are a complete scam.
They broke our so called "contract" first with no services in the first 30 days. Why should we paying them for no services?
I have had horrible customer service been lied to, hung up on, and put on hold with no warning.
They refuse to compromise.
They will not hear our side and just demand money for non services.

1- Claimed to be google in Nov, 2012.  Claimed you could pay Google to be on the front page by phone call invite only.

2- I told our sales rep our business address and she was confused. They also had my name wrong.  Elaine said it was because there are to many departments.

Egumball has decied to settle this contract instead of paying them $1668.64. They were kind enough to settle if I pay them $1200.00 and take down every reiview I have posted or add a resolved to the post. I never did recieve any services from them but I'm happy to no longer due business with them. You can decied who is lying. Just do your research before signing any contract with egumball.

Thank god there are two sides to every story.  

FACTS:

1) This person claimed there was no agreement and claimed there was a fraudulent transaction involving a credit card.  As soon as we informed this person that it was our intent to contact local police and federal authorities her story collapsed and she admitted to transaction.

2) This person claims to have submitted 50.. AGAIN 50 .... listings to Google.  This is spam and any professional knows what adverse effect this will have.

3) This person told us that she would take the reviews down if we refunded $300.  This is extortion.

This person will change her story and will continue to put new spins on new defenses that arise.
