I have been an independant sales rep for Stacey Ward of Wireless Advantage since July of 2004. Her company is in Texas, and I live and work in Arizona. I have had my commissions repeatedly shorted, mis-appropriated or just not paid by this company since December of 2004.

It started when I had a company cell phone. She began billing me for the phone when I had a low amount of sales. She would take the billing out of my owed commissions but I would never see a detailed bill. She then shut off the phone but billed me for 2 more months, including another line on the same account that a friend of hers had used and then stolen from her store. I ended up paying around $500+ for a phone I couldn't use and another person's cellular phone and usage.

The next thing that happened was that instead of sending me a check to pay me, she would send me accessories and then bill me for them, with the assumption that I would sell these items to customers for cash instead of her paying me. I never ordered or asked for the items she sent.

Now I am owed commissions dating back to March that she refuses to pay me. She sent me a commssions statement but "forgot" to put the check in the envelope in March. In April, I never received anything. In May, I finally got a check on the 12th of May that should have been sent to me in April. It was sent to the wrong address (purposefully) and then to top it off, it was an NSF check for over 2 weeks. It was also not the full amount owed to me.

I am now being told that I owe HER money for accounts that have been deactivated, and she was charged back for. She still owes me commissions for my April sales, and for the March check that she forgot to send me.

HELP!! What can I do? This is a totally dishonest person who is embezzling her employees commissions for her own use. She also takes cellular payments for customers and spends the money herself, instead of sending them to the cellular companies owed, and the customers have their accounts turned off for non-payment.

Do I have any recourse here?
