Complaint Review: Wu-Yi Tea Source/IW-Living Lean Las Vegas

Wu-Yi Tea Source/ IW-Living Lean Las Vegas Wu-Yi Tea Company promised me a refund. I sent the tea back, and they charge me $19.95. They are fraudulant and have different websites to entice consumers into their little trap. What I want to know is, was this particular tea company advertised on Oprah. If so, she and the company have a lot of explaining to do. Ontario Canada Internet

I went through the following conversation with an online representative for the company regarding my refund after discovering the tea is quite ineffective, and can also be bought nearly anywhere for much less:

James: Welcome to Wu-Yi Source, I hope you have had a great day so far. I am happy to assist you with any questions you might have regarding the tea, which has helped countless people around the globe.

you: Hello I ordered the trial, was not satisfied, and would like my money back. In addition, before I had made this known, a second shipment was sent to me that I am definately not interested in using. How can I return that order for my money back?

James: Could you please provide me with your full name and email address or your order number, so that I can pull up your details?

you: Your Name

James: Ok, please wait for a minute, while I check your order.
you: No problem. Where do I find the order number?
James: Alright, you have been removed from the autoship program and you will not be receiving any further shipments.
James:
James: As per the Terms and Conditions you agreed to before placing your order, your card has been charged the discounted rate of $54.95 for the two full month's supply of slimming tea that have already been shipped to you (ships 30 days after placing your initial order).
James: Please return the portions of tea you wish to be refunded for to:

Please send package back either UPS, FedEx, or if you prefer to ship via USPS, please ask for "Delivery Confirmation". You will be provided with a tracking code - it is very important to PLEASE KEEP THIS TRACKING CODE.

Refunds are processed every two weeks; you will receive an email from us immediately after we have refunded you. Please include correspondence in the package with your reason for return and write your RMA number CLEARLY on the outside of the package so that we can identify it as yours, which is:

James: Your refund will show up in your account in 7-10 business days, all refunds are subjected to 15% restocking fees. (15% Restocking Fee applied, as per Terms and Conditions which were agreed to before order was placed.)
James: You will be refunded $48 minus restocking fees. i.e. $40.80.
you: The 3 pg "Welcome" packet says I will be refunded in full if I am not satisfied.
James: It's clearly stated that we'll charge 15% restocking for all returns.

you: I understand what the website says, however, another document from the company says I will be refunded "every penny." If that is not true, it is false advertising, and quite clearly a lie.
James: As I said above, You will be refunded $48 minus restocking fees. i.e. $40.80.
you: You said I paid $54.95. Your companies documentation contradicts itself. I should be refunded in full. I suggest you speak with someone regarding the flaw, and accomodate the customer who trusted the black and white print that says she will be refunded "every penny."
James: It's clearly stated in our terms & conditions that we'll charge 15% restocking for all returns.
you: James, you can continue referring to the "terms and conditions" on the website, while I continue referring to the documentation I was sent with the shipment, and we will get no where. So, I suggest you speak with someone else who may be able to make a different determination on the subject. Really, if you bought a product with a "every penny" back guarantee, and found out it was not so, you'd be a little disappointed.

James: I apologize but it is clearly stated that a 15% restocking fee applies.
you: James, again, I can go ahead and type the whole 3 pg documentation in my case, but I feel I have already wasted enough time. $8.24 is nothing to a company as large as yours. To me, however, it pays for a couple gallons of gas. Mind you, I must also pay to ship the package back. Correct?
James: Yes, Right
you: Well, that puts me out about $15.00 for an unwanted product. If there's anything you or your company can do, please let me know.
James: No need to worry at all, As soon as we receive your product we will refund you.
you: I certainly hope the glitch is understood, and the $54.95 my card was charged is refunded in full. If it is not, I will be contacting the Better Business Bureau on grounds of false advertsing. This is not a threat, it is a solution to a problem that can and will affect customers in the future. I understand this is not your fault, and most likely not your decision, so have a nice day.

After all this, of course I received no refund...only a $19.95 charge for who knows what.
