Wynn's is refusing to pay for parts and labor covered under their warranty. The failure is in the sunroof or the skyview of my Mercedes ML320, the trail, motors and the panels, are all defected and need to be replaced. Wynn's sent out an adjuster to the dealership, and the dealership provided all the necessary documents to proof these parts are all defected and need to be replaced.

The adjuster declined the claim immediately, because the car was brought back 7 month ago for an alignment of the skyview panels, which is totally different issue. The adjuster documented everything as working fine, and only alignment is required this time as well, and it should be the dealership responsibility to fix.


Although the dealership mechanics strongly emphasized that its a part defect and its impossible to fix the trail, the panels and motors gain, they are majorly damaged and the only way to fix it is replace the whole thing. I called Wynn's thousand times and each time I get a different story, and different explanation on why they are declining the claim. They tell me, have the dealer call us and provide us with a proof that there is an actual defect. The dealer provided all this information already.

I call Wynn's again, I talk to a different person each time, and I have to start telling my story all over again from scratch. So after I was able to convince them that the parts are defcted,

now they are singing a new song, they tell me the the only reason they would cover the parts only if the roof breaks by itself, they think the panels bent the trail and caused the damage, and they should only cover it, if the whole thing quit working without any cause, if this was the situation, which will never be the case in a million years, so basically Wynn's is doing its best to come out of this deal without paying a penny.

This is dishonesty, and unethical practice, I payed money for an extended warranty and I expect some kind of help, all I know my car is in the shop for 4 weeks, and I spend hours and hours over the phone talking to Wynn's with no hope. They are a total RIPOFF!! and someone should stop them.

I would recommend taking them to court.

I am not sure how much it is in your area but it should be fairly cheap. If you think you can win there is nothing to loose. With my warantee under covered parts it is listed as "Timing Belt." which my car has two, which has been proven to them by the Mits dealer. (Galant, Mitsubishi). The claim adjusted said he understood it was called "Balancer Shaft Timing Belt" but because its main purpose was balancing they would not cover it even though it is not in the Exclusions. They have no case. Back to you, I have recieved little help I sent in my court papers. If you have a valid claim that is what I would recommend. I have been without a Car since March paying full coverage on a car that does not work. I would settle the claim for a new engine instead of what I am going after them for. .. (Court Cost, Insurance, Towing, Car Rental etc)
