I took out a Payday Loan on 5/04 for $300 form Xpress cash. It was one that gave you a charge ($90) unless you pay off in full + the charge. I set up a payment plan for them to withdraw the money to pay off the loan (a little less than $360b/c I was paying on it) and another loan ($360)from PD whistler. The PD whistler loan wasn't even wanted I went online; didn't complete the application. Few days later I get $300 in my account.

In 2005, I spoke with Heather Lawson to set up a payment plan. Then in April, I notice $90 charge being debited 2x/month. I didn't do anything because I thought it was going to my balance. After 2-3 months, I contacted
Heather Lawson who told me that the $90 charge was an error. I even spoke with a manager.

I thought that everything was resolved until now. I paid off the balance. I was in contact with Heather to make sure the balance was correct. It was paid in full in Jan 2006.

Today, June 17 I was reconciling my bank account to
see that $90 was removed from PD6 Whistler. No telephone call, no email, no letter. I haven't moved.
Just out the blue, $90 gone!

I called my bank immediately and was told to contact
PD Whistler. If PD doesn't refund the money (they won't b/c I've tried this before) then I need to contact the bank again for a dispute. I'm also contacting the Federal Trade commissioner.

I don't want to close my checking account but will if needed.

#2Consumer Suggestion

I have had the same thing happen to me...$90 electronically withdrawn twice a month, only I never applied for a loan. DMS Marketing somehow got my bank info and started helping themselves to my money. I had to close my account and have filed a fraud report with the bank. DMS finally contacted me after they couldn't withdraw anything more from my account and when I asked to see my application, they could not produce one. They did a conference call with me and my bank to verify that funds from them were deposited in my account and the bank told them there was no deposit from them.

I suggest that you close your account for starters and file a fraud report as well. They asked to see a police report but I did not file one. I informed them that I would if they need one, but it would be to press charges against their company since they did the unauthorized withdrawals. I haven't heard back from them on that yet.

Whatever you do, do not give up! After reading these reports from other people, this company needs to be stopped! We work too hard for our money!
