In September of 2004 Ms. Cappa/McGrath sold me a Maltese/Yorkie mix puppy for $1050. This puppy came to me at the age of 12 weeks with a one year written health guarantee (which she failed to provide me a copy of), as well as falsified health records.
The puppy had worms, earmites, kennel cough and a congenital eye defect that required three surgeries to correct.
I contacted Ms. Cappa/McGrath regarding the vet bills incurred as a result of this eye defect, but she refused to honor her guarantee, and as a result, I took her to small claims court (and won). I had to hire an attorney to aid me in collecting the monies owed, and she eventually did pay me the judgment awarded.
Now that my dog is once again healthy, Ms. Cappa/McGrath is using a photo of her on one of her many websites, claiming that she is one of her "breeders". This dog has never been bred and was spayed before she ever went into estrus.
I have not given Ms. Cappa/McGrath permission to use this photo, and despite my asking Ms. Cappa/McGrath to remove my dog's photo from her website, she thus far refused to do so.
