April 5, 2000 I had my car towed to B&B (Brown and Brown Nissan) to install a transmission and evaluate ongoing engine problems with my remanufactured engine. (That is how this all began separate story) B&B's lead 300ZX technician confirmed problems with the engine immediately. He informed the service advisor Craig Kineart to call ATK and coordinate a warranty claim to replace the engine. I was told it would take about 10 days to get the engine replaced and the new one installed.

Two weeks later I called to find out when my Z would be ready. I was told they hadn't even called ATK yet. Craig said he was so busy he never had a chance to call. He promised to call ATK the next day. Week after week it was one excuse after the other.
July 2000 I called ATK to see what the delay was. They didn't know anything about it because Nissan never called to start the process. So they opened a claim and gave me the information for Nissan. All that Nissan had to do was perform a couple of tests and report back to ATK.

September 2000, I called so often that every one knew my voice. I went to Nissan and found out they still had not done anything! I stopped the service manager Bob Garackuas to ask if he could find out why his people were putting me on the back burner. He was shocked that my car was still there. He assured me that my would be given the highest priority.



October 2000, I called ATK to find out if they had any information on the status of the claim. Nissan had the car so long that the warranty was now over. ATK saw that the delay was because of B&B, so they were kind enough extend the warranty.

November 2000 My health was deteriorating due to the stress of B&B not doing their job as promised, no car and loss of income. I would call and fax every day asking about he car. I asked if they would like me to contact ATK. They said no, it was taken care of and that ATK wanted some unreasonable tests done to confirm the faulty engine. And they would do the tests after they cleared out some other cars. I firmly reminded them my car been there now for over 4 months and my car should be first. I went in and spoke with the Service Manager again, who promised my car would be taken care of immediately.

December 2000 I faxed Nissan and reminded them this was my only means of transportation and I was sick it was the holidays and needed my car. They never replied. December 27, 2000 Twice I called and get put on hold and then dropped. I sent a fax saying I be there in the morning.

December 28, 2000 I get there and the car is already out front, running and ready to go. I saw Craig and flagged him down. I asked about the warranty for the new engine. He looked down and said, Well, Chuck is out of town, and I could not find a problem with the car. I had to take a deep breath to compose myself. I said, So nothing was done other than the transmission? His reply, we replaced a seal. Chuck will be back in a about a week. Drive the car around and see if you still have problems with it. My car was there so long so that everything would be done at once.

January 10, 2001 Took car back to Nissan Craig said they would only have the car 2-3 days. After 5 days I called Craig who said the tests had not been done yet. Give him another day or two. I hesitantly agreed. 3 more weeks went by and they still didn't do anything. Meanwhile my transportation is the city bus, bike and roller-blades.

January 26, 2001
E-mail to We Care at Nissan: I brought my Z in January 10th for work that was to be done the 12th. I have left messages to find out what is going on. No one has returned my calls. This is my only vehicle.

January 29, 2001 ATK still had not heard from Nissan. Called Nissan, Craig said he was getting Chuck on the test that day.

February 2, 2001 When I arrived at B&B Craig said they did the tests that morning. It reacted to the cylinder tests. They would call ATK and make arrangements to get the engine replaced. One week later, they still hadn't called ATK. So I called Don Roy. He phoned Craig, and 5 minutes later called me back and said there is enough evidence to replace your engine.

February 8, 2001 ATK promised to check out the engine and have another one on its way within 48 hours after receiving it. (if it was due to defect on their part)

February 9, 2001 B&B promised they would remove the old engine and have it ready for ATK s FedEx pick-up within 24 hours of getting the car. They also promised to install the new engine as soon as they received it and would work with ATK on the labor.

February 13, 2001 I took the car to Nissan. Craig said they would start on it by that evening. Faxed ATK let them know the Z was at Nissan.

February 16, 2001 I went to Nissan to make sure they had sent the engine to ATK. Craig disappeared when he saw me. I stayed there an hour but was not able to get a straight answer about the engine.

February 21, 2001 Sent a fax to Don at ATK to see if they had received the engine. Copied Nissan on the Fax

February 27, 2001 Sent a Fax to Nissan telling them they've had my car for 2 weeks already.

March 2, 2001 Phoned ATK, spoke with Jennifer. She was VERY upset with B&B. ATK had sent Fed-X out 4 different times to pick up the engine. Each time it was not ready to go. ATK engines is willing to state on record that Brown and Brown Nissan was irresponsible and deceptive in their dealings not only with me, but with them. Craig called and left a message that the engine was picked up that day. He made it seem like they have been waiting on ATK to have it picked up. (message saved)
March 9, 2001 Talked to ATK. They are covering the engine under warranty and will be Fed-xing a new remanufactured engine to Nissan.

March 16, 2001 Received notice from ATK, that Fed-X delivered the engine to Nissan on March 14, 2001. Looked up the tracking number #405826382139 and confirmed the delivery.

March 19, 2001 Car should be nearly done since B&B promised they would be on top it! I left messages for Craig. He didn't return my calls

March 21, 2001 I called Craig and he said they had not started the car, because they had accidentally sent the valve covers back to ATK. And were waiting on ATK to ship them to Nissan.

March 22, 2001 Craig called the car would be longer than expected. It needed some additional parts. And that ATK had not sent the Valve covers yet. List of parts they said need replacing: Alternator, Thermostat, Water Pump, A/C idler/bearing, Head temp sensor, Left and Right exhaust manifolds: Craig claimed they were cracked and warped

March 23rd 2001 Went to pick up parts, was told by a service advisor that the head temperature sensor and harness, water pump and thermostat were sent back to ATK with the engine along with the valve covers so they would not be with the parts. That sounded fishy.
Faxed to Don Roy at ATK inquiring if Nissan had requested my valve covers and the other parts Craig claimed were inadvertently sent to ATK with the engine. Reply. All we got was the engine. No other parts are here (ATK) Don Roy .

March 24, 2001 Opened box of parts from Nissan. Strange, some of the parts they said they sent to ATK are in the box.
Alternator was good, but had a bearing going out. Alternator replaced under warranty. Purchased a new alternator belt.

March 29, 2001 Purchased: Water Pump, Thermostat, Head temp
NAPA inspected the exhaust manifolds and concluded there was no evidence that they'd tested for cracks.

April 2, 2001 J&B repair checked out the Exhaust manifolds. They agreed with NAPA. They were neither cracked nor badly warped. (warped less than a 64th of an inch, which they easily corrected by truing them)

April 4, 2001 Droped off the exhaust manifolds and AC Pulley.
4-11th Spent hours/days trying to find the hardware for the exhaust manifolds. I was referred to CopperState Nut and Bolt who manufactures bolts. They don't produce bolts for the automotive industry. Told me my best bet would be Nissan.

April 13, 2001 Purchased Exhaust manifolds Gaskets at NAPA.

April 17, 2001 Dropped off gaskets. Bolts were in so I get them $60.25

April 19 - 20, 2001 Sent 6 faxes sent inquiring about the status and when would the car be ready for pick-up No response at all.

April 22, 2001 Craig called to tell me that 2 of the parts I brought were not correct 1 was purchased there. He also wanted to tell me that they forgot to let me know that I needed motor mounts.

April 23, 2001 Picked up parts. B&B had the sensor but not the mounts.
23-26 I searched all Nissans and auto places in the state; no motor mounts to be found. Then ABC Nissan found them for me.

April 26, 2001 Paid $170.00. ABC delivered the mounts

April 28, 2001 Craig said they would not start the car until Monday.

April 30, 2001 I called Nissan to make sure they had started the car but had to leave a message. No answer to my call or faxes.

May 1 - 3 2001 Sent faxes saying is it ready yet? No response.

May 4, 2001 My son called Craig, he said the car would be done that day.

May 9, 2001 I get a call the car is done and it will be 1700.00+ for labor! They told me they would accept assignment for the labor from ATK. The agreement was: I provide them parts and they would not charge me labor. I never received an estimate, written, verbal or implied.

Every aspect of my life has been detrimentally effected because of Brown and Brown's deplorable behavior. The list below can only show monetary items. Nothing can change or compensate for the stress related heath problems I've developed or the inconvenience and frustration I have endured because of Brown and Brown.

I feel they owe me $6828.21 just to recover money lost due to their actions. Below is a beakdown of the Total.

$2,205.00 = Canceled work (car over due) = $70.00 X 31.5 hours

$2,400.00 = Forfeit 12 wks @ $200.00 at Memory Etc. For on-call
Dragon Naturally Speaking Instruction

$750.00 = Faxing, writing, phone calls = $25.00 X 30 hours

$256.25 = Rental Cars to perform contract service work

$40.00 = Public Transportation

$1120.00 = 3 weeks use of clients mini-van Barter.
16 hrs, 4 onsite computer service in Gold Canyon 76m per trip.

$36.96 = 22 gallons gas to refill Mr. Whitsons Van

$20.00 = Gas money to be picked up in Gold Canyon, AZ

Car is completely Faded needs new paint job $2,800

Leather Seats faded and ruined $2,500

$12,128.21 Total

Plus my time & aggravation for 1 year $5,000 (bargin)

I want to take the Z to a shop of my choice and have the car thoroughly inspected. Should further repairs be needed due to shoddy workmanship, B&B will need to cover the expense. I do not know how much it will cost to have my car repainted or the have the special Taupe leather seats restored but Nissan needs to pay to have this done. Along with paying for a rental car while this work will be done.

Oh my gosh! This story is unbelievable! I had a horrible horrible experience with them as well, and after reading this I have decided to submit mine so others will know NOT to do business with these people!! I have been to the Better Business Bureau on the internet, who gives them a SATISFACTORY record! I hope all that have had this same sort of unprofessional service also submits their complaints to the BBB too.
People need to know that this place is UNsatisfactory, and needs to be shut down!


My car was definitely sabotaged by Brown & Brown ..I feel like I am sitting on a time-bomb, just waiting for the most inopportune moment and BAM!

I am still suffering the after effects of picketing in the 112 degree heat. My health took a major nose dive! I developed fever-blister type sores on my face and legs as a reaction to the sun, heat and Chemo. This along with the still- on-going Z nightmare shut my whole body down. I lost my speech and shortly there after I went into Sleep-Mode. (I was nearly comatose,

only woke up to empty my bladder) I was in sleep mode for 4 days and 4 nights.



Also, my car was side swiped while at Brown and Brown Nissan. The passenger side mirror and side have been scraped down to the metal and the fiberglass for the mirror is both cracked and paint missing. There is a crease dent in the hood with a big chunk of paint missing. As well as large chunks of paints and what looks like the car was keyed over every surface of the Z.



The nightmare continues: Frustration, anger, disappointment, distraught, pissed-off, sick and tired and tired of being sick. I figured I better have Z checked out to make sure B&B didn't do anything else to it. So I took it to West Valley Nissan. On the way there it was over charging. They said they would give it a good checkup and it would be about 3 hours. I put on my roller blades (alternative transportation) and skated to my sons.



It was about 2.5 hours later, and they called to say I could pick it up. So I put my skates on and skate back to Nissan. I asked what they found. They confirmed the alternator was bad. But figured they would really check it out when I brought it back to replace the Alternator. They wanted $358.00!



Of course I declined because this one was brand new and just installed with the engine. They offered to do an exchange but the labor will be $120.00, and they would need the receipt for them to do it under warranty. I didn't have the receipt on me. I asked if it would OK to drive back to Tempe and bring the car back in a couple of days. Sure! You can drive like that for days!



I asked again if it would be OK to drive back to Tempe. Again they said yes. So I got in the Z, started it up and now it was not charging at all, just opposite of when I brought it in a couple of hours earlier. So I drove around to the service advisor and told him "now it's not charging at all, will I be OK to drive to Tempe?" he said, Yes



When I took off, I noticed the air coming from the vents was HOT. But figured since it was parked in the sun and it was hot, that it just needed to cool down. Wrong! It was not cooling down. So I drive back to WV Nissan to have them check it out.



Over an hour later they still could not figure out why it was blowing hot air, when it was blowing cold when I brought in 3 hours earlier. I mentioned more that once.... "Since the alternator is not charging maybe there isn't enough juice to run the air" He said no, that is not it. They thought I had a leak in my cooling system. And they put fern in. But that didn't work.

They mentioned that B&B probably didn't hand turn the compressor once a month to keep the internal seals from hardening. They said they would find the problem when I brought it back for the alternator replacement. They said I'd be fine to get home.



While driving home in 109 degree heat, my Z died again! I am not joking! On the freeway coming home from Glendale. URGGGGGGGGG I got it jump started, again and again and again and every 2 to 3 miles, it took me over 4 hours to get home.



I get it home and take a bus to go BUY a new alternator cause the other one is in the car and I can't get it replaced under warranty until I get it out of the car. Another $200.00 expense. The car was dead, I have no money at all to get it towed or pay for the repair. So I borrowed some tools and changed it myself.



Alternator replaced, and air conditioner works! How about that! But it still is not running correctly. Who knows what evil deeds Brown and Brown may have done to my Z. I feel like

UPDATE: The victim that filed the original Rip-off Report above became very ill after picketing and then getting stuck on the Interstate 3 times in less than 48 hours in 114 degree heat. She was driving the car that Brown & Brown took a year to fix. Brown & Brown said it was fixed, but in reality it was not fixed.



We are told that many other victims have contacted her since the Rip-off Report was first filed and her picketing the dealership.



More picketing will start as soon as the victim is well again and the temperature comes down. Other victims will be joining her including possible employees who were victimized as well.



She will be submitting her UPDATE in a few days.



Brown reneges on deal to get back my car ..Still being taken for Z-Ride

Another long day in the hot sun. More people who came forward to share their Brown and Brown rip-off experiences. One man drove by with a sign on his car that said, Ask me about the Lemon I just bought at Brown and Brown Nissan.



When I went to the gas station I ran into a couple of people from Brown and Brown. They encouraged me to keep picketing that it was great to see a public cry for help to expose B&B.



Former employees told me that B&B has the highest number of dissatisfied customers and notorious for deceptive practices and warranty rip-off in the entire AutoPlex. They know the law inside and out and walk a fine line so they can't be sued. They will lie to cover up their rip-off and make it seem like the consumer didn't pay attention to the fine-print that they claim

they had them read.



While picketing I received a call from badbusinessbureau.com consumer advocate. He said, B&B had called him and they had agreed to release my Z. They wouldn't give me any money for my expenses or ruined paint and seats, but would let me pick it up and call it even, not having to pay the $1,800.00 bogus charges.



Like I said, all I ever wanted was my car! They told Ed over at

badbusinessbureau.com in California, to have her put her signs down and come and pick up her car! She can have it, just have her put her signs down and take her car. Just after I got off the phone with Ed a police office came to speak with me. The officer said, Brown and Brown said you can have your car. All you have to do is go get it. The Police Officer also stated to me, You also have an old transmission you can take as well. ..That surprised me, how did he know I had a transmission there. So I asked, he said he was in the room while they were talking to the consumer advocate Ed from badbusinessbureau.com. That struck me as odd why was a police officer behind close doors in a private meeting about a customer?



Ed from badbusinessbureau.com called me and urged me to get out of the heat because I was not feeling well and it was 110 degrees out. So my son & I rolled up our signs went over to the pick up area, reluctantly. I was both excited and nervous at the same time.



You can image my disappointment when I walked up and saw my Z sitting there I hardly recognized it because the car was so faded and old looking. When I went inside the waiting area, the employees were happy to see me and were very sympathetic, also angry with the treatment I was getting from management.

Comments were made by the employees about how Bob Grackaus straight out lied about my car being in the sun for a year. And others said, ask us about being ripped off, we can tell you things that would make your hair stand on end.



Finally Craig came out and said I had to write them a check for $676.20 in order to get the car. I said the police officer and Ed from the badbusinessbureau.com both told me an agreement was reached to give me my car and we'd call it even? Craig would neither confirm nor deny that was the agreement. So I went outside and called Ed from badbusinessbureau.com and he

did indeed confirmed that I should not pay a dime!



My excitement turned to anger because they were already lying to me, again. As I sat there I looked at my car and tears started to roll down my face. Why? Why, I kept thinking is Brown and Brown doing this to me.



I took a little break and then continued to picket in the 110 degree weather. This situation has effected every aspect of my life. I am a strong person, but this is more than any one should have to endure. B&B knew that I had just gotten off chemotherapy before my Z went into their shop. They said they'd take good care of me, and I didn't the stress of the car situation,

so just relax, they would take care of getting my car straighten out once and for all. Yet they put me through so much in the last year that I have now been put back on chemotherapy and I am not to be in the heat, sun or get stressed. I have lost my speech several times, (like a stoke) The doctors have said it is directly related to the stress that B&B have put me under

with the my car situation.



The next day my son and I were out there early. We wanted to get good coverage so we decided to roller-blade and picket. When B&B saw me they got in my car and drove it away! That made me sad and so stressed I began to feel weak. By early afternoon I was beginning to feel extremely weaker and very disoriented. We took a break and then picketed until 6:30.



The next morning when I woke up I looked very pale and was weak. My husband didn't want me to go picket but I had to! I just can't stand by and let them rip me and other people off. Someone has to stand up for what is right. Even if that means I need to do a little suffering along the way.



Friday afternoon, my mother in law became very ill and I needed to get to Phoenix. She lives in a rural area and the closest bus stop is over a mile from her house, I don't feel up to the riding my bike the 21 miles to her house or taking 3 different busses and a mile walk. I've lost so much work and already spent over 400.00 on parts for the Z I and other expenses, I could not afford a rental or cab ride.



Saturday morning, still very weak, I decided to pay the $676.20 and get my Z. I was wiped out. Physically, emotionally and bank account. I go to get the car. They took over 20 minutes to find the keys and get it started. When I got in the car to take off I noticed all the lights on the digital display were on.

It was missing and didn't sound right. Of course no one would talk to me. So I told them I was MAD! They've had my car a year and now it's messed up! But I was not about to leave it there any longer.



Fifteen minutes later on Interstate 17 the car died! Can you believe it! They sabotaged the car! I could have been killed! They had taken the nut out of the rotor and it went flying around in the distributor. The car is over charging and is not running properly. It was 112 outside and here I am again

broke down on the side of the road. I can't tell you how angry I was!



I called the old shop foreman from Brown & Brown who was now with West Valley Nissan, because Brown & Brown wrongfully terminated him when he would not go along with their deceitful practices. When I took the Z to B&B a year ago he wasn't there and I did't know where to find him. After a few months I started

calling all the Nissan dealerships until I found him. If my car had NOT been in pieces I would have had it taken to him at West Valley Nissan, but I didn't think this would turn into a year ordeal and life threading situation. I plan on taking the Z to a few different places to get it thoroughly inspected to see what if anything B&B has done to my car.



Other victims and myself will start to picket all the Brown Family dealerships in the Valley. They must be stopped!

I know them, I worked there, those dirt-bags!



I worked for these people several years ago at another one of their dealerships. They are the most unscrouplous two faced lieing bunch of people I have ever met! I remember one sales manager bragging after secrewing over a young hard working Hispanic man who said he would sue Brown & Brown. The wise a*s sales manager stated, "no one can win in the courts against us, all the judges in Mesa are Mormon, we never loose."



Brown and Brown also known as Mormon and Mormon, short many employees on their hourly pay. Promisees they make are never kept to both employees and to the consumers. They act like they are above everyone else. Yah, they look clean and well mannered and give the appearance they are good people. They are the devil in disguise.



They should all be arrested for fraud to consumers and put in jail. We all know that will never happen here in good old Arizona.



Imagine, these are good Mormons from the Church of Jesus Christ of Latter Day Saints. I wonder if they will get a Temple recommend and go to heaven in spite of all their dirty deeds?



...even if you are a Mormon, you still have to take "it" in the Brown when you buy from Brown and Brown.

I'm Mormon. As much as I hate to agree with much of what has been written here.



As a Mormon, let me tell you, even if you are a Mormon, you still have to take "it" in the Brown when you buy from Brown and Brown. And we all know what "it" is!



Mr. Brown and all other Brown families. You should be ashamed of yourself. You are a disgrace to our church and you are helping to fuel the anti Mormon propaganda about our great Church.



How do I know all this? A family member who works for you is ashamed to admit they work for you, because they see what you do or what it is you don't do when consumers are screwed in your sales and service departments.

Q: Why would anyone in their right mind spend ALL day picketing in the hot AriZona sun? I asked myself that same question many times while walking up and down the hot sidewalks at Brown and Brown Nissan in Tempe at the AutoPlex, at the corner of Test Drive and AutoPlex loop. (just in case anyone would like to join the battle tomorrow)



A: At first I was out there trying to get my car back. But as the day went on I began to see a pattern. A pattern of people who have been victimized by this very same dealership! They would honk and roll down their window and tell me how they too have been Ripped-Off by Brown and Brown Nissan. They showed their support by honking their horns, yelling things like: down with those M%$#$% F$%^$, Yea take the slime-bags down! In spite of the hostile feelings had for B&B peace signs and thumbs up were the gestures of the day.



I really felt a sort of special bond with all the people who stopped and told me their B&B rip-off horror stories. I was saddened by all the horror stories I was being told. In just the time I was there I heard more than 10 accounts of the great B&B rip-off. That is scary! That was more than one per hour. Not including the ones who didn't stop to tell there story, there were at least 20 more people who yelled they'd been ripped off too.



One woman just bought a brand new 2001 Maximum and has had one problem after the other. She wrote to Mr. Henry Brown, Mr. Tim Brown, Nissan Corporate, and AutoNation, no one responded. She, made calls, sent e-mail and wrote more letters! All she got was excuses and the runaround. She finally brought her attorney with her and then they listened. But she said, they are still not living up to what they promised her attorney. She may take the day off work and picket with me.



One man told me how he didn't realize B&B deceived him until he received his payment coupons from the bank and the payment was more than $200.00 OVER the payment quoted. To top it off, he's had his Frontier in the for service 4 times for breaks in 4 months. They just can't seem to get it right



And the man who said his mother brought her car in for an oil change, when she got it back it didn't run right. Well the service center inadvertently drained her Transmission fluid. A couple of days later, her transmission died. B&B gave her a years worth of free service coupons! Yea, right, like she'd ever go there again! (He was on his way to the Dodge dealership)



This is crazy! While picketing, on the lawful sidewalk, a big woman in a golf cart with a B&B Employee badge nearly ran me over. She came whizzing by riding on the sidewalk and came right at me and my son. I had to jump out of the way and was nearly run over by a car passing. Thank goodness my son caught my arm and kept me from falling.

Don't they get it? Good will always prevail over bad. Sometimes it takes awhile but it will prevail! We are now in the information age. In an instant, a blink of the eye, information can be disseminated around the globe. In the past companies could get away with ripping people off. Consumer information was rarely available; and if it was you couldn't count its validity. Companies that aren't honest and don't treat people fairly will be PUT out of business because they won't be able to hide behind the corporate security blanket. At first I just wanted my car! That's all I ever wanted. My little red 300Zx to be repaired correctly and in a timely manner. I was not asking for it to be done for free; I just wanted the repairs to be done accurately the first time and end Znightmare I've been living. But now????? You tell me!
