On 9/September/2001 I purchased window tinting from:
Ziebart located at 2021 s 108th st
Milwaukee WI 53227.

At the time of purchase, I was told that they used the best tint film in the industry, and because of this it was guaranteed not to peal, bubble, and most impressively to me at the time, fade. Recently, I noticed that one of my windows was bubbling up, and I took my car in. I talked to Matt, one of their assistant service managers, he looked at the bubbling and said they could replace the window but it wouldn't match the rest because it was too faded. I told him that was ok, I had the lifetime warranty for that too, he asked when I had had it done, and when I told him it had been several years, he said oh ok, from back then. Come on in and we will schedule an appointment for them to redo it, when are you available next week, my tinter isn't here today.'

We set an appointment for the following Tuesday, May 03, 2005. When I arrived, Matt saw me, went in back and I herd him tell Mike, another assistant service managers, he would have to handle me. Mike came out and told me that he wouldn't be able to retint the entire car, they could only do the one window, and that would cost me twenty dollars to have the defective tint removed. He then told me that their warranty didn't cover fading, and showed me a copy of their present warranty, which states this:

WINDOW TINT: The Window Tint installed on your vehicle is warranted by the issuing dealer not to delaminate, crack or peel for the duration specified on this warranty. Should any such defect occur, it will be replaced by the issuing Dealer at not charge to you. This warranty does not cover scratching of the film or physical damage from any other cause.

This was not supplied to me at the time of the sale, in fact at the bottom of the form it says FORM #304093 AC (09/01) meaning it was at best created four days before I bought my tint, quite probably not in circulation until well after my purchase. I would like to point out that even if this had been what was represented to me, which it was not, how do you read, (Should any such defect occur, it will be replaced by the issuing Dealer at not charge to you.) as you will be charged twenty dollars to remove the old tint, then we replace it free of charge.

I ended up talking to the owner,(according to Mike) Nathan Krueger who told me that he didn't own the business when I bought the tint, so he wasn't responsible for the representations made to me when I purchased my tint. He told me that i would have to contact the old owner of Ziebart, and if they agreed to pay for it, then he would honor the warranty. I would like my tint replaced like I was told by Matt that it would be when I also want an apology for wasting my time by sending me away from my appointment empty handed, and unsatisfied.

From matt's statements, I am lead to believe that this is a known problem, and they are just trying to avoid their responsibility.

I still have my original invoice which states that it has a lifetime warranty, and it provides no exclusions.

I would like the original terms satisfied, and have my car retinted. if this is to difficult, I would like a refund of $208.61 so that I can go elsewhere for proper service.
