Complaint Review: K9 GLOBAL RESCUE - Denver, Ocala Colorado, Florida

Mr. Barocas, YOUR negligent and defamatory statements contained in your rebuttal Rip Off Report dated June 10, 2023 have been forwarded to my attorney. YOUR explanation that Haberman is no longer associated with K9GR since February 2020, is contradictory to Haberman’s podcast on April 2023, with Siebert. Therefore, I will take into consideration that all of YOUR other statements contained within the rebuttal are questionable. YOU have falsely stated publicly that I am "a known criminal who makes a living suing for slander and defamation”. I am not a criminal, nor do I blackmail anyone. I do not make my living suing for slander and defamation. Further, YOUR rebuttal claims I use an alias that I never have sued. I do not have a "long history of blackmail” – these statements are defamatory and negligent, and YOU may be subject to litigation. Obviously, YOUR research on me is faulty. There’s no "long and elaborate list of suits filed against individuals for slander/defamation”. For clarification, there was one case filed in 2015 in Texas, which I prevailed. I do not "hide behind the 1A by naming you" as your rebuttal claims. How does a person hide behind the 1A? I am unaware of any other profiles and online sites in which I slandered YOU. Just because you don't like what is truthfully stated, does not constitute defamation/slander. I have never threatened YOU and I do not appreciate your exaggerations. Because of YOUR false statements and involvement in the Haberman civil cases, YOU are now a party to this fiasco whether YOU like it or not. YOU drew first blood. I am a respectable paralegal for 23 years and have been in the legal field since 1988. Haberman’s and YOUR non-profit frauds were exposed prior to me sharing the This Ain’t Hell story written by John Lila in 2018. YOUR rebuttal falsely accuses me of "threatening to sue K9GR for me contacting YOUR FB followers" when I shared the story. YOU falsely claimed I wrote the story to your followers and social media. We went through this in previous litigation, yet you still twist the outcome. The This Ain't Hell article was written on May 29, 2018, by John Lilyea who attached a letter from the DOJ booting K9GR and Haberman/Drager out of the country. This article exposed K9GR’s fraud in Jordan. I did not have anything to do with the story and merely shared it after it went viral. After this, YOU participated in having me arrested for sharing the story, violating my First Amendment Constitutional Rights. I have copies of several emails between YOU, Lilyea, law enforcement and others, where YOU made exaggerated and false statements about me. YOU filed false police reports against me for something YOU knew was not a crime. YOU falsely testified in July 2018 against me after I was dragged to Florida from my home state of Nevada without proper jurisdiction for a wrongful charge. I could not remove the online journalist articles posted about Haberman and is not a criminal act, yet YOU and Haberman continued malicious prosecutions against me. The damages YOU and Haberman did to my reputation and financial status was/is monumental. After spending 6 months in jail in 2018, I took a plea of 3 years’ probation because YOU filed a second charge for sharing the TAH story and I would have to wait another 6 months for a trial and because the serious cervical injuries I sustained in the transport that went without medical treatment while detained. After successfully completing probation, ALL charges were dismissed. The Judge stated I could write about Haberman, talk about Haberman and post online. I continue to express my 1A rights. YOU and Haberman participated and schemed in having me subsequently arrested in 2019 and 2021 for the exact same charges previously adjudicated in my favor. After those dismissals, YOU again participated in an attempt to have me arrested in October 2021 for the same charges. I have evidence YOU provided false statements to governmental authorities and law enforcement. As a direct result of YOUR false statements and continued involvement, YOU were named as a defendant in the current litigation. I did not "drop the suit against you” as you falsely state in the rebuttal. The Judge dismissed you as a defendant based on jurisdiction because you live in Colorado, which does not mean you are in the clear. It merely means I can proceed in another forum to which YOU will then have to submit to jurisdiction. YOU state in your rebuttal that Haberman is no longer a part of K9GR since February 2020. Please explain why YOU allowed Haberman to incorporate K9GR under the false name of Phil Drager, and YOU continue to white out his name on the 990 Forms. Why has Haberman used the name of PJ Johnson in connection with K9GR in journalist interviews? Why was Haberman allowed to wear full military BDUs with military patches during YOUR "missions" which were posted on K9GRs websites? Why were the other volunteers allowed to wear military patches? YOU recently removed Haberman's photos, but this is not evidence of Haberman's status with K9GR. If Haberman is nothing more than a volunteer, please explain Haberman’s pod cast in April 2023, wherein he states he is "the facilitator of the dog rescue side and Jon is the facilitator of the humanitarian side”. Haberman is now utilizing this military site to recruit for K9GR falsely claiming he was imploded by an IED while in Iraq and has PTSD from his multiple tours. This claim of military experience is totally false and has been the subject of all the online journalist’s stories to which YOU and Haberman had me falsely arrested for. Please explain how Haberman is able to post fundraisers, yet not be involved with the donation platform as YOUR rebuttal states. I have contradictory testimony by YOU that YOU do and do not have military experience, yet claim "our experience enables K9GR to go where other organizations will not or cannot go for safety reasons”. This generalized statement needs clarification. If YOU are claiming YOU are a Veteran, please provide your military credentials. Who else in the organization management has combat experience, if not YOU or Haberman? The post merely asked how is it that K9GR is able to go to those places that no one else is able to. You have not explained this in your rebuttal. Haberman is a veteran with three (3) Other Than Honorable Discharges, and he is not a combat veteran. Evidence shows he falsified military documents in 2005 in an attempt to gain a Purple Heart and other accolades, which most likely has been used to validate his military credibility. FOIA exposes all of these false statements of Haberman’s military experience. YOU explain and tout your credentials in YOUR rebuttal, but avoid explaining the Jordanian military fraud, several hurricane frauds in North Carolina and Florida, and the questionable Korean breaching of private properties including the video of Haberman claiming K9GR stole a German Shepherd dog that was an alleged military dog. You personally have at least one of the dogs from Korea and so does Haberman. Bucha is now Haberman’s dog from the Ukraine. The Rip Off story merely asked a question: Who paid for their transports? It further asks where the funds come from. YOUR rebuttal explanation was that YOU "loaned $78k from your own pocket with audited credit card charges". Past Form 990s posted on K9GRs website fail to account for assets. YOUR explanation was you received an extension from the IRS because of your lengthy 16 months in Ukraine involvement. Sources tell me you were not entirely in the Ukraine for 16 months and returned to the US. YOUR posted Form 990s do not satisfy the question for the prior years of assets and expenses. As a historical note, K9GR has been delinquent each and every year. The post further asked where all the donations were coming from and how they were tracked because the Form 990 does not match with the charity donations received. I would be shocked if you actually provided those statements from all the charity donation websites. YOUR rebuttal fails to explain why K9GR was wearing military gear with military patches. I am not aware of any other rescues in Ukraine wearing such military gear. YOUR rebuttal fails to explain why K9GR redacts and hides the faces and identities of their volunteers. All non-profits I know have no problem providing this information and are happy to show their volunteers' faces for validation and praise for their hard work. The secrecy surrounding these questions and your rebuttal only casts shadows on the legitimacy of K9GR. Obviously, I hit a nerve and it bothers you. I have always supported several animal rescues and your hard work, however, the surrounding circumstances have over outshined your good work. YOUR defamation statements contained in YOUR rebuttal will be answered by my attorney.

I have read the report filed by this individual against the non-profit company I am the executive Director of.  I want to preface this first by saying that the individual who filed this report and a former volunteer have been involved in a hotly contested court case against each other for over 16 uears.  The individual who filed this report has filed previous reports which only name her former husband and K9 Global rescue. This time she has chosen to name me in this new report.  To that end I will respond to her irresponsible, slanderous statements. 

1. K9 Global Rescue was established as an official US based 501 (c) (3) in May 2017.  All donations are 100% tax deductible

2. I, Jon Barocas, worked throughout Asia since 1998 fighting the dog and cat meat trade. I have concentrated in Korea for the past 14 years disrupting and saving dogs from the dog meat trade.

3. All financials, IRS 990 forms are listed on the K9 Global Rescue Website under the legal tab.  Each year we have posted the finacials, which is not a requirement.

3. I have personally loaned the organization over $78,000 (audited credit card charges) with the majority coming in the past 16 months.  My loans to the organization are listed on the tax returns each year.  This year K9GR has received an extention from the IRS because I have spent the majority of the last 16 months in Ukraine and could not file in a timely manner.

4. All donations, made through any number of online platforms, PayPal, Venmo, Zelle, Stripe go directly to a dedicated bank account listed as a US 501 (c) (3) under K9 Global Rescue which is the account listed on the yearly IRS 990 form filed. Every donation platform issues a year end 1099 indicating the total amount donated.  Yes, Venmo does issue a year end statement as well. 

5. The business of rescue is not an inexpensive journey.  Every trip requires a budget ranging from $5000.00 to $17,000.00 depending on number of volunteers, flights, hotels, equipment, medical supplies (animal & Human), food (animal & Human), transportation, gas, daily incidentals.  It is an enourmous undertaking. We now have teken, as of June 10, 2020 a combined 16 trips in 16 months by 2 teams ranging from 8 days to 28 days.

6. Phil Haberman has never had access / signature or authority to the organization bank account, or any donation platform.  His name has never appeared on any IRS tax return.His expenses submitted for missions are reimbursed by me once all receipts and reports are submitted. Anyone legitimately investigating a non profit can request the organization details from the donation platform and will find their non profit status listed as required by that platform

For the past 16 months we have been on the frontlines and support lines in Ukraine.  We work with both humanitarian aid organizations and the Armed Forces of Ukraine, which is necessary in an active war zone. With our experience we can go where other organizations can not or will not for safety reasons. Some in our org have combat experience in the US Military, some support profiles and others served in foreign military.  All are veterans. All are outstanding individuals who have risked their lives, given of their time away from family and put themselves in harms way many times over.

The individual Haberman who was mentioned in this report is no longer with the organization. This individual was one of the founders of K9GR but resigned that position, effective Feb 1, 2020 and has served only as a volunteer since February 2020. The woman filing this report has threatened to sue K9GR for defamation after contacting our Facebook followers with an article about her ex-husband Phil Haberman and our letting our followers know her intent, at which time she threatened to sue us for slander and defamation.  In the following years I found that she had a criminal record and a long and elaborate list of suits she has filed against individuals for slander/defamation.  A long history of basic blackmail, I'll sue you unless you settle first.  i guess its her way of making a living. Now that Haberman isn't with the organization maybe she will move on to another mark.

We have worked in Ukraine with several well known and respected humanitarian aid organizations.  K9 Global Rescue is responsible for saving over 500 dogs and cats from the war torn front lines.  This is a true and proveable statement. We have brought several dogs to the US after the pups were quarantined in Poland for the required time.  I do not have any dogs from Ukraine, as stated in her report.  I have delivered 3 dogs in the Denver area to friends, 1 to Wisconsin, 2 to Florida, 1 to Chicago and 1 to NY to families that opened their hearts and homes to these traumatized pups.  Not one of these families has ever paid an adoption or transport fee.  All these costs, like the costs of being a non profit org are covered through generous donations or by me personally when we fall short of funds and listed as loans on the IRS 990.

The woman who named me in this report has a long criminal history and a longer history of hiding behind the 1st amendment and suing individuals claiming defamation and slander.  She has gone by two or more aliases Kristen Dougherty, Kristen Rhoads being the most common.  Since she is hiding behind the first amendment by naming me, I guess I've now done the same thing in return.  She named me and K9 Global Rescue personally in a law suit with 26 other defendents, including law enforcement, prosecutors, her former husband and his wife and individuals.  She has since dropped the suit against me and K9 Global Rescue and 23 others, but has decided to slander me personally online using a number of alias names and profiles.

I will always be transparent and open to discuss the organization.  My phone number and email address are on our website and Facebook profiles. Maybe now that she knows her ex husband is no longer a part of K9 Global Rescue, she will concentrate on her efforts to derail him and not an organization that actually does something in this world to better the lives of those without a voice.
