"AS IS" WARRENTY ABUSE /FRAUD FROM A USED CAR DEALER

I bought a used 1994 Ford Explorer Auto 2000 outlet located at 15328 FM 1825 pflugerville,Tx. 78660 on 05/29/2004.Within this first month I had returned this vehicle over 4 times to the dealer for several serious problems brakes pulling to the passenger side and grinding, transmission not engaging or slipping when I drove down the road and fuel lines leaking on the engine block.

The first time I had to take it back I was told that it was fixed they changed the brake calipers that would be ok now when asked about my fuel lines he said I would need to bring it back another time to leave for the day. I arranged a time that week to leave it over night and was told then that they fixed it when asking for a copy of the work order he said we don't give them out. This time after looking at the work I told them they had put the wrong type of hoses not the kind for a fuel line and they needed to re-fix it that the lines still kept blowing off causing serious driving dangers in traffic (didn't move)This is the lines that go to my brakes, fuel and transmission.

I received the truck back at this time with new hoses and no clamps to keep them in place. My brakes and transmission continued to not work right the brakes continued to grind and pull and the transmission still slipped or did not engage. I requested my money back so that I could purchase a vehicle else ware since it was obvious they could not fix this vehicle.

On 07/21/04 Charlie the sales agent I had been working with all along agreed that this was not something that could be fixed and offered me opportunity to trade for another vehicle on the lot for equal value telling me that was my only option since he could not refund me my $500.00 deposit. The only thing that even would start at the time was a car 1992 Mitsubishi. (Far from a utility vehicle that I had wanted for family reasons) I was told do not worry about the mileage it had a new motor and transmission just put in so it was a "good deal" I test drove it for as much as you can had my son look at it seemed fine until 2 hours later off the lot it broke down making a lot of noise and racket I called them immediately and let them know which they offered to have it towed back to them to do any repairs needed .

My vehicle was with them for 4 days( I had to get a rental) I was told it was fixed and it was the alternator. I have it back and not even 100 miles placed on this car and the motor blows!! Bottom line I asked on both vehicle to have a copy of work being done on the vehicles and I was told "we don't do that" then after being told that this vehicle had a new motor and it blew with only 100 miles on it I highly do not think this was a new or even rebuilt motor. I am suppose to make my FIRST payment on this 2d vehicle with them on 08/11/04 but this is my situation its not that I don't want to pay it but when I called to find out what they found was wrong with the vehicle (they never called me after taking it to there shop) I was told that it was the motor blown and that as soon as I have $1500.00 they will fix it and I can have it back. WOW !!

I am afraid to make a payment and try any more to resolve this issue with them due to them towing my broken car back to them and telling me I would need to pay them $1500.00 to get it back. Now since I am not behind in payments they cannot do this legally. I am out a car, my money I have full coverage insurance that I do not have a vehicle but have to continue to pay so that it is not canceled until I buy another one.

I know that used cars are "AS IS I was going to be paying a lot for my vehicle and I went to a used car dealer because of credit issues not because I wanted a car to pay on and not drive. I expected a car that would run. Lemon Laws should cover this or Fraud Laws should. This dealer sold me a car knowing that my intent was to have a vehicle that ran minor issues are reasonably understood but under the circumstance this was plain fraud the theft. I asked to speak with the owner and was told that that was impossible and she would not even speak to me. (Good business practice if you know you are ripping people off) I have reported this to the motor vehicle department and I am awaiting an investigator I have reported it to the BBB. I have lost so much work in the last 2 months (I am a loan officer I need my car) I have a baby grandson at home and I am under the impression at this point I have to take them to court.

I intend on going to court. I will not have this placed on my credit report due to there insane business practices. If all is gained I hope that others will be more aware of lack of rights in buying a used vehicle and do not get taken advantage of such as I did from this State licensed dealer taking advantage of the Texas AS IS vehicle laws to rip of customers.

Below is the expected cost of both vehicles that did not run. I know I did not check the blue book first and that I was unaware of the interst being higher when I agreed to the second I just wanted a car that ran and was frustrated, mad that I was forced into a vehicle I did not really want but needed something to drive or my money back.

My Request is this: I would like a full refund of my deposit for $500.00 down and I would like my payments made to them as these vehicles still were in there shop more than with me I was unable to drive and had to receive a rental. Cost of $ 600.00 for a total of only $ 1100.00. This is not including any lost wages! I only want what I put out so that I can leave this all behind me. If I go to court I will request court fees and loss of wages.

my credit report is now corrected as it should be and they did remove all of the debt they said I owed for these cars that did not ever run. after a long and un needed battle I did win. It pays to fight when you know you are right.

2000 Auto Outlet is a very customer oriented used car lot. They are always willing to help your situation out no matter what it is. I purchased a 1998 Ford Explorer from them, with the down payment being defered. I put 500 down when i drove it off the lot and was suppose to pay the rest of the down payment in two weeks. I had a family emergency that i had to attend to in ST.LOUIS, MO. I was late paying them the rest of the down payment. I spoke to charlie on the phone and explained my situation and he said just pay what u can afford to pay now and when you get paid again, to just pay the remaining balance. Now that is customer service. they could of easily took the truck back but instead they were willing to work with the customer. I highly recommend 2000 auto outlet to anyone who is looking or in need of a used car or truck. I wish there were more used car lots like 2000 auto outlet. Thanks for the pleasant experience guys.

Barbara, what are you thinking, giving this business your money twice? What time limit does your state law provide for purchases most state laws have a 30 day refund or a chance for you to change your mind. The next auto,truck etc you purchase please take the time to research auto carfax, etc even take down vin number and go to dmv for a record check 15.00 fee I think will tell you previous owner, or is it stolen? Then once your find your best car take it to a true certified mechanic that you trust to look over your auto. If dealer will not allow this then walk away there are more reputable dealers than the dishonest ones just remember you are the one in charge. 2000 auto sounds like they are buying there autos from either an auction outlet, or other dealers that can't sell the cars because they don't pass their customer satisfaction safety checks. About your auto you have now I think your best bet is to paint it the ugliest color you can find and put a non removable sign on saying never buy anything from that car dealer. Good luck

There are several issues they neglected to mention. Like the bumper was NEVER repaired in my possession.It was not months of time that was between repairs or needs I only had 2 vehicals in 2 months!I did NOT say my son was a mechanic he is only 18 and works in a restruant he simply came with me there were no talk of why or who he was.I was told that the 2d car had a new rebuilt motor and to not worry about the millage listed the motor blew within 2 weeks!They NEVER offered a deal with the 2d car they took it and told me I had to pay $1500.00 to have it fixed.I did not scream and yell at them (karma will come back)I simply clearly stated I was not happy with each issue each time I had to return or return a vehical.I am still not happy. I had the state of Texas investigate this company and found out they have several law suits pending and a criminal suit. (I assume from so many faud suits)After speaking with an investigator from the state and a 3 way call with the company, investigator and myself this company would now like to work out something with me.(funny state had to be involved to get a simple act done) I again assume because of the severity of there situation (they also have a new owner now) I was told by the sales agent that I could come by to work out the numbers to purchase yet another non warrenty vehical. As soon as I was done this call I received another call back form auto 2000 outlet to tell me now I would have wait until the "good cars came back from san antonio from having transmission work done and this would be yet another 10 days of me not having a vehical. I asked if my money from the last 2 vehicals would be applied and was told he was not sure I could come by work it out. I did not get the money from the 1st vehical applied to the second so I am leary about the 3d! I am awaiting the vehicals to return to see what offer I am able to recieve. I have gone through too much with this company.I have lost alot in my employment with the loss of my vehical ( I am a loan officer -vehical required)not to mention 2 vehicals now on my credit report and lost of money spent. After finding out the legal issues this company has and knowing what I know now about how a car dealer can intentionally rip you off sell you junk and get away with it "as is" I still know I did the right thing by letting others know about the shady dealing going on in the industry. I am sure they are not the only used car dealer around doing this as much as I am sure not all are like them.Just be sure to ask in writting the blue book value, get the car fax on the vehical checked you would be surpised I was!( Carfax is a legal document to use in court) I also learned that I can buy a warrenty from another dealer which when i asked was told i could not get one they new nothing of this? Better yet only buy from dealers that do offer an warrenty to be safe. This matter has not been resolved they are still leaving me with no vehical,they have my money and are not sure they can even offer to adjust the money I have paid to the next one and if I do not agree with some term I will have to go to court or I will have a repossession on my report because I will not pay for what I did not have. I will follow with an update to what the outcome is when have a call letting me know what there offer is.

This was my response to the Better Business Bureau on 08/14/2004. The BBB respose was "Although your customer has directly stated that they are basically dissatisfied, the BBB has determined that your company has acted as it reasonably had a responsibility to do. A record of their experience will be maintained. We have also answered to Ms. M. complaint to the State. As a used auto dealership, we do our best to make sure that vehicles we sell are in working order before we sell them. However, we do not provide any warranties and vehicles are sold as-is. On 05/29/2004 we sold a 1994 Ford Explorer to Ms. Barbara M., who was happy with the deal she had received and the dealership upon completion of the deal. On 07/19/2004 after a couple of months with the truck, some problems surfaced, Ms. M. called yelling and screaming threatening us, I asked Ms. M. to calm down and asked her to bring the Explorer to us. We gladly took the vehicle in for our mechanic to diagnose. Out of courtesy we agreed to repair the vehicle although it was sold As Is without a warranty. We replaced the bumper she damaged the day she bought the vehicle when she was backing out of the car lot, we checked out the brakes on the vehicle which Ms. M. stated were pulling and grinding, the brakes were ok, and we replaced the transmission fluid line because she stated the transmission was slipping. All of these repairs were done at our expense at no cost to Ms. M. The following day Ms. M. picked up the 1994 Ford Explorer and as far as we knew she was happy with the vehicle. A couple of days later Ms. M. called and stated the vehicle was having the same problems. I explained to her that the vehicle was repaired out of courtesy at our expense, and again out of courtesy that if she is not happy with the 1994 Ford Explorer after she had it for two months that we would allow her to choose another vehicle comparable in price to the Ford Explorer. At that time I asked her to bring her own mechanic to look over the vehicle, to ensure she is completely happy with her purchase because just like the 1994 Ford Explorer purchased on 05/29/2004 the vehicle she selected would be sold As Is no warranty. Ms. M. was happy that we were willing to help her out; she said her son Brian is a mechanic and she would bring him with her to look over the vehicles before she selected one. On 07/21/2004 Ms. M. and her son who she stated was a mechanic came by looked over our inventory and chose a 1992 Mitsubishi Diamante, her son looked the car over and went for a test drive with his mother Barbara. When they returned from their test drive the car would not start up, her son said it was the battery cable, we replaced the battery cable and the car started right up. I confirmed with Ms. M. several times that this was the car she wanted, I explained the vehicle we are trading her into is being sold to her As Is just like every other vehicle we sell to anyone who purchases a vehicle from us. She agreed to the price; which was $1,000.00 less than the price of the 1994 Ford Explorer. Ms. M. signed her contracts and forms including two different As Is forms. Again I explained the vehicle is sold As Is no warranty. She said we can pick up the car and keep it, said she was going to file against us. I explained again we traded her out of a perfectly good 1994 Ford Explorer; which she was not happy with that we resold on 07/24/2004 and have not had any problems with the current owner, into a vehicle which I asked her to inspect thoroughly with her own mechanic. I offered to repair the vehicle and charge her our cost for the repair. She was not willing to take this offer.

A few hours later her son called asking what we could do, he asked if we could look at the car and let him know what the problem is so that he could fix it. Our mechanic diagnosed the car; I let her son know what the problem was he said he would fix it. I asked him to have his mom call me so that I can make sure she is ok with that. Ms. M. called, calm this time, said she would send her son to pick up the car for him to fix. On 08/09/2004 Ms. M. called again very upset said the car was broke down said it overheated. She said we can pick up the car and keep it, said she was going to file against us. I explained again we traded her out of a perfectly good 1994 Ford Explorer; which she was not happy with that we resold on 07/24/2004 and have not had any problems with the current owner, into a vehicle which I asked her to inspect thoroughly with her own mechanic. I offered to repair the vehicle and charge her our cost for the repair. She was not willing to take this offer.
