I originally saw the car on eBay and contacted the dealership for more info. I told them I would fly to Miami right away to inspect the car before purchase. They said that was unnecessary as the car was like new and they would ship it to me. I told them I wanted to see if with my own eyes and then they said i needed to give a deposit of $1000 so it wouldn't be sold before i got there.

with in 24hrs of giving the deposit i flew to inspect the car and found these issues that were not in the advertisement. They had false and misleading advertisement.

1) power assist trunk did not open or close with the motor / power.

2) hundreds of rock chips on the front bumper. Not described in the eBay listing

3) Services up to date, when I asked for the service records the salesman could not provide them

Their ebay listing said "drives like it did new, needs nothing"

Also while I was at the shop one of the sales man pointed out a car they would be selling that had been deemed under the LEMON LAW. He said even Lemon cars can be great cars!

This all made me very concerned and i told them i didn't want to purchase the car and wanted my deposit back. This all took place less than 24hrs of me giving them the deposit. They also kept the ebay listing active and never adjusted the info in the advertisement. They said that they would not give the deposit back and every communication with them on the phone since has been rude and unresolvable.

yes they have positive feedback on eBay but if you do more research online you find out I'm not the only one with issues with his dealership. Another customer bought a car that had a blown motor when they received it. look on rip off report

I told them i did not want the car within 24hrs of putting the deposit down and seeing the car in person. After saying i didn't want the car because of it not being as described, the salesman said there was nothing they would do and that a car with that many miles normally has rock chips. Reason I was buying a car in florida and not somewhere like Alaska was to avoid that. Eventually they called me again and offered to paint the bumper or get a new key. I said i would think about it but most likely my wife would still not want it. Then i called them back and told them no for the 2nd time.

On eBay it clearly says $500 DEPOSIT YET THEY HAD ME GIVE $1000 WHEN THEY KNEW I WOULD BE THERE WITHIN 24HRS. Why such the need for a larger deposit ? Especially if they knew i was coming right away? why not easily cancel it when it was less than 24hrs?

It really comes down to the fact if they are such an honest and good dealership, why are they making such a huge deal out of me not wanting to purchase the car and didn't return my deposit? not once did they ever try to fix the situation, they just yelled at me for not buying it.

ITS BECAUSE THEY ARE SHADY! customers stay away. Glad I didn't end up with car, who knows what underlying issues it has.

As we responded in our previous Rebuttal, all rock chip pics and wear and tear disclaimers are open can can be viewed on our ebay page. There was nothing hidden from the buyer.  We post over 100 pics and every angle of the car for that exact matter.  Close up pic of chipped bumper was also posted.  Customer simply changed their mind and found another vehicle closer to home.  Rock chipped bumper was a simple excuse not to buy this unit and ask for his non refundable deposit back.(Also stated on our ebay listing page)

They sure now how to take pictures lol good thing i took a few when i was there. As you see in their picture it doesnt show many rock chips, thats how the ebay listing was

pics 1,2,3are of their car with 100s of rock chips, bumper needs to be repainted, which after me telling them i didnt want to buy it they agreed and said they would paint it. I didnt want to buy a car that needed anything done to it. May have to zoom in to get a good image.

pic 4 is of the another 5 series with 80k miles on it with normal amount of rock chips for florida or any other sunny state

Also look up another persons complaint for 2013 when they bought a car from this dealer and once it got delivered they found out the motor was blown!  Stay away, you have been warned.

Cars not as discribed, lemon cars and blown motors.

We complied with everything as we should have. We are a top ebay seller and we know all the rules and regulations. Trunk was not broken , was reprogrammed to work immediately.  Service records are all on hand and were offered to be emailed to the buyer, just couldn't print them out at the time. Rock chips disclaimer is ON EBAY page so is the close up pick of the front bumper(please view attached pics). His wife said she doesn't want the vehicle because of the rock chips (based on80k mile car/normal wear and tear) we even offered to do a chip repair or refinish that bumper like new just to please this buyer. Then after that wasn't enough for them to get their deposit back they also requested that they will not buy this vehicle because it doesn't have 2 master keys, which we also offered to provide to help them with this purchase.  They aren't buying a new car please keep that in mind.  They chose a 76k mile BMW that was priced as such.  If they want a perfect car with no rock chips might as well go new.  I feel like we did more than we had to in order to please these people and even offered extras on top. They finally said that they will most likely buy this car just goto decide weather or not they want the extra key or rock chips fixed. Then next day after key was on order it was a NO again. This all lead us to believe *CLEARLY* after they thought about it for a few days you simply changed their mind and decided not to buy this unit.  The whole point of a deposit was to get them locked in this vehicle and secure it personally so nobody beats them to the purchase.  That's the purpose of a non refundable deposit.  We did this exactly to hold this vehicle for them .  We keep all vehicles online until the sale is fully finalized. It's removed from all sources one we get fully funded.  We did everything as we should have on making this deal happen for them and if they had a change of heart or found another vehicle closer to you that's on them.  This customer decided to leave us a negative review over not getting his deposit back for being indecisive and definitely NOT over "Rock Chips" on a 76k mile vehicle.  That's simply absurd.
