I have had nothing but trouble with ABN since we financed with them. We had to pay our 1st year of insurance then set up an escrow account. Almost immediately they started sending notices that they were going to put forced insurance on us if we did not prove our insurance. We have always had insurance, but they keep making us pay not only for it but the forced.

Our notes have gone up over $300 from the original amount. And we recently found out that they didn't even pay our insurance last year. Therefore we can no longer do business with this company. Which makes us look bad. We were on time the first year of our mortgage, but then I lost my job and we got behind, So we filed a Chater 13 Bankruptcy. We are 100% pay. Which means everyone will get what we owe them. But since we have done this they keep sending our notes back and trying to foreclose. We finally got the judge to tell their Attorney that they could not foreclose. So now they just hold our payments until they feel ready to post them.

In the meantime we have to pay all the late fees and interest. As we still have about a year left to our Bankruptcy we cannot refiance. So we are between a rock and a hard place. I am thinking of suing, I don't know what to do. My husband and I work very hard for what we have and we have 4 small sons, all under 11, and I don't want them to lose their home. Does anyone have any advise??

I am so sorry for what has happened to you. You still may be able to refinance your mortgage dispite the fact that you are in a chapter 13. I know for a fact that Wells Fargo is able to provide refinancing options and I believe Long Beach may also have options as well. Qualifications do depend on how long you have been in your chapter 13 and the equity in your home. They may also be able to pay off what is left on the chapter 13. Hope this helps!!!
