Next time anyone says something different than the contract, it would probably be in your best interest to have them note it on your contract before they separate the 3 sections, so that you have it in writing. Just as your mistake in not having it "in writing" does not make all consumers look unintelligent, one bad rep doesnt make a whole company bad. If every customer could make ungrounded claims (not saying yours is) them no company would be safe from scam artists or confused customers. If a pattern of deceit is established be sure that salesperson will be canned.

I work for an ADT dealer in WA state. I also worked for ADT directly. In my state we offer a 3 year term. At the end of the 3 years you will then go month to month. You must provide a written letter to ADT 30 days before the end of your contract to cancel the contract! Read the contract. Don't cry wolf after the fact. This is why I try to get all of the responsible parties to be present at the signing of the contract. I also point out the 3 year term as well as the need to write a letter if you chose to cancel at the end of the term. On the contract you have to intial this part of the contract. You also have 3 days from the signing date to cancel. CA and some other states offer 2 years for monitoring. But it's up to you to read and understand the terms. Sorry you felt riped off. Next time make sure you are there it go over the fine print and understand what you are signing up for. Sounds like a misunderstanding to me. I think the sales person is owed an ammends.

As Joseph claims, we have never met, but I also don't know my wife to be a liar. But, in fairness to Joeseph, I will give him the benefit of the doubt and simply state the facts to update this report. ADT claimed they contacted Joseph on my behalf and on more than one occassion to have the contract adjusted. I was told by ADT that Joseph and only Joseph could alter the contract and an adjustment was refused. Honestly, this made no sense to me. ADT was basically telling me that the person who sold us the contract was the only person who could alter it, ADT headquearters could do nothing. I'm not sure how a sales rep could have more power than HQ. Joseph, please keep in mind this is what ADT, your employer, was telling me, if they never contacted you (which would not surprise me at this point), my apologies indeed. I filed a report with the Better Business Bureau who contacted ADT on my behalf. ADT quickly responed and left me a message claiming there was a resolution. When I contacted ADT they said the resolution was no resolution. Amazing. As a consumer who had put my faith in a large, well known company, I was feeling powerless. I decided to contact the Attorney General and file a complaint with the Consumers Affairs Division. They quickly took my case, contacted ADT and had my contract adjusted to 11 months. I suspect they may have done this without involving Joseph? I'm now free of ADT and will not ever use their services again. Thank you Joseph for taking the time to respond to this complaint.

My name is Joseph Morte. My reputation and integrity are being questioned by a Mr. Eric as a result of a so called "Bate-and- Switch" tactic which he is accusing me of using while attempting to secure a contract for the re-activation of an existing Alarm System at his home in Newark,CA. First of all let me say that I have never met Eric. Negotiations to re-activate his security system took place between myself and Ms. Yvonne Ku (spouce/domestic partner) of Mr. Calande on 07-20-07. Therefore anything Eric has to say on the subject had to have been explained to him by Ms Ku, long after the scheduled appointment. I have never spoken with Eric either by phone or e-mail, nor have I corresponded with him in any other way. As to the allogation that I "LIED" to secure service, I would simply let the record speak for itself. I have never before, during or since that meeting of 07-20-07 EVER promised any customers that I would negotiate or secure a month to month contract for them and that includes Eric and Ms. Ku. Despite Eric's claim, I had no knowledge that this type of contract option ever existed. If I had, my offer of such options would be on record, and would have been directed toward much larger/more lucrative accounts. In this case, a simple re-activation on a "USAA Member" contract totaled $23.99 per month. This was a discounted contract with no Warranty or Service plan. The commission amount that I earned in this case was very low in comparison to even an average "California Member" contract and there were no bonus incentives pending. Therefore, no motive existed for my behaving the way Eric claims. To have walked away without a contract, in this case, would not have been detrimental. I made decisions based on need rather than greed and never regretted any. I do regret any mis-understanding or mis-information directed at Eric. I expect no help or support from my former employer, ADT Security Services, regarding this report, as none was ever given to any sales rep ever employed at their Pleasanton, CA location. I would suggest Eric expect none either. I am, however, demanding a public apology, on this site, by Eric, for these slanderous accusations, and committ to further action, regarding this matter, if it becomes necessary.
