Advantage Financial Services (AFS) attempted to communicate and collect from our son-in-law, my wife's two medical accounts.  When AFS sent us in their response for document, they removed mention of the medical accounts and replaced them with papers on an account that we had disputed.

AFS matterial altered two blanket assignment, overwritting the last digit of the year to make it look like the generic blanket assignments were made before being assigned to AFS.

Fair Debt Collection Practices Act Section 807, False or misleading representations and failure to communicate that a disputed debt is disputed. I.R.C.P. Rule 11.  AFS signed the signature of their attorney, Shaun R. Bonney on the complaint in violation of the FDCPA and I.R.C.P.

AFS failed to report to the credit bureaus that a debt was disputed.

FDCPA section 807 (10) Used false representation or deceptive means to collect or attempt to collect debts.  We were told twice in collect letters that we could not direct to where our payments where applied. This is also a violation of section 810.

FDCPA section 809.  I AFS never sent me the required statements, orally or in writing.

FDCPA section 808 Unfair practies.  AFS added our daughters medical accounts to the payment arrangement that we had made to pay my wife's two medical bills without telling us.  In response to my requests AFS both admitting doing so, and denied doing it at the same time.

AFS filed a misleading collection affidavit.  The Consumer Financial Prection Bureau (CFPB) and the courts have said that these affidavits must be specific to debts and to the consumer.  They admitted that they do not kept a copy of ever notice they send.  Because they did not have what they claimed, the submitted a collection letter written to someone else on a date before any of the medical accouts they claimed that we owed.

AFS and their attorney, Shaun R. Bonney violated Idaho Tilte 26 Chaper 22 Collection Agencies, Idaho Statute 26-2229-A(1) that requires debt collectors to deal "openly, fairly, and honestly without deception".
