 On Jan 6, 2013 I paid cash for a personal protection weapon. The company was Amendment Arms. They was marketing a new Hybird asault weapon called the Joshua Mk5. When I paid $1056.10 cash for this weapon I was told by Tom Wise that it would be ready in 90 days. Even signed a contract to that effect. Seeing how I was one of the first 200 people to pay upfront for this weapon they offered a rebate of $200. Which Tom now said I'm not due.

90 days came and went. Six months rolled around and No weapon. Nine months came and went. A year rolled by and still no weapon. After 18 months I finally received an email that my new Hybird was ready for pick up. I was excited. Been waiting 18 months and watching the hype on Amendment Arms web site about their progress. They showed pictures of their product and really built it up.

I went to the factory on July 18 at 6:00 pm as instructed to pick up my new weapon. The designer was hard at work on my weapon. I watched and waited as he worked hard to make all the parts fit together. Finally after an hour he put his face mask on and hearing protection on and moves to the range for the test fire. He fired several rounds and brought the weapon to me.

I'm still excited. Christmas has arrived in July. I hurry home and on the way home my phone rings and it's Tom Wise telling me that the firing pin was hitting the primer hard on my weapon. He said if I had any issues with it to bring it back to them. He never said not to shoot it or it was dangerous.

 I got home and hurried outside to shoot my new personal defense weapon. Earplugs in place I pull off a round and it fires and jams. I cleared the jam and pull the trigger two more times and it jams again. I try the magazine they provided with the weapon the next day and it wouldn't even chamber a round.

On Sat morning I'm with some buddies to show off my long awaited weapon when we decide to see how it shoots. I put the mag into the weapon pull the trigger and again it jams. I cleared it and pulled two more off and the bolt jammed shut. No opening it by hand. I was asked by my friends to put my weapon away. I was very embarassed. It was my range we were on.

I sent Tom an e-mail letting him know what has gone on and he said to bring it in and they will fix it. After taking a hard look at the gun. Amendment Arms had put my weapon together using "USED" parts. Not new parts but used parts.

I took the weapon back to Amendment Arms on Monday July 21. I met with Ryan Croft CEO and designer. Ryan took a hammer and hit the bolt to get it open. I presented to Ryan a letter requesting my Cash payment of $1056.10 back. He never read it or picked it up. He was very professional and very apologetic and I left.

Today, Tuesday, July 22nd,  I sent Tom Wise an email to find out when they would be returning my purchase price and he informed me that there was No way I was going to get my money back. They didn't offer a Satisfaction Guarantee only a warranty against parts and workmanship.

I don't want a personal protection weapon that fails to function on the first shot. I want my full refund back. I would never deal with Tom Wise ever again. Mine was only the third weapon they delivered. I feel sorry for all the other God fearing Gun bearing Americans that are waiting for their Joshua Mk5.

All they had to do was refund my money and I would have gone away. But NO! First Amendment "Freedom of Speach" I'm very upset and all of America needs to know what happened!

 This company uses a arbitration clause in its contract and Web site that makes you unable to sue them for your money or because of faulty products. The following link shows why not to do business with this company. givemebackmyrights.com/bma-faq.htm Don't make the same mistake I did the contract isn't worth the paper it's printed on. I paid the full contract price and waited 1.5 years before asking for a refund which the contract said I could ask for after 90 days. Still don't have a gun or refund! Don't trust this business.

From Tom Wise:

Regarding the rebate, it is $200 paid over 5 years, as agreed in the contract.  Randy received $40 in 2013 by check.  The remaining $160 he traded for an upgraded barrel.  Randy now claims the upgraded barrel, a Lothar Walther, was supposed to be free.  That has never been the case.  The upgraded barrel has always been $160 (plus tax).  So Randy is not due a rebate.

Regarding Randy's wait, we always answered Randy's emails or calls, and he chose to wait for our design to be finished.  Everyone knew in advance they were buying something not yet built.  It is an unusual business model but many people signed up, not just Randy.

After Randy left with his Joshua MK5 rifle, Ryan informed me that the firing pin may have had an issue.  I immediately called Randy to transmit that information, and suggested he bring it right back or be very careful.  He chose not to return the rifle right away. 

The fact that Randy decided to take a gun that jammed the evening before to the range the next day is not an Amendment Arms issue.  Randy should have immediately contacted us and not brought the gun to the range.  And certainly not invited his friends until he knew the rifle was 100%. 

After Randy came by, he left his weapon with us, as is proper.  We looked it over, and the firing pin indeed had an issue.

Regarding used parts, we have informed everyone from the start that at the early juncture we would be using AK kits for bolt carriers and other parts in the Joshua.  This is even in our videos online.  It is not hidden information. 

The firing pin was NOT a used part.  We make the firing pin.  This one had an issue.  It fired fine just before we handed it to Randy.  We noticed the issue with the primer right after he left.  We could not have moved any faster in telling him there was a potential issue. 

Now, our refund policy.  The contract Randy, and every customer, signs clearly states that there is no money-back guarantee once the rifle is delivered. 

We do, however, provide a full warranty on parts and workmanship.  The warranty Randy received when he picked up his Joshua also states this policy.

Randy threatened many things if we did not return his money.  We don't work that way. 

My final reply to him was "We'll write you when your rifle is ready."  And we will.

 Isnt it funny how YOU as an American and a "God fearing gun toting" individual can remember the first three words of your first amendment rights yet TOTALLY ignore EVERY bit of the rest. While YES you DO have the right to freedom of speech you DO NOT have the right to spew whatever you feel like, especially over the web. While I agree, the cost of the weapon you purchased was expensive, after 18 months they are NOT going to give you a refund. Just because YOU WANT a refund doesn't mean that they have to give you one. There is no DIRECT law that states that a consumer is allowed a refund. You can check for yourself. There is "Lemon Laws" there are "Fraud Laws". Those are instances of wrongdoing and a refund is normally in order. BUT!!!! Just because your EXPERIMENTAL weapon isn't working the way you want it to immediately, is no reason to demand a refund. Your right to a refund is SOLEY at the discretion of the business owner. So if you want a refund that badly I would suggest that you take your head out of your rump and start acting like an adult and sucking up to the very same people that YOU are demanding a refund from. YOU are NOW trying to FORCE them into giving YOU your way. YOU have made what is pretty much a "Blackmail" post. YOU THINK its going to work but there is a problem. YOU WILL NOT BE ABLE TO REMOVE THIS POST!!! SO its on the web forever and since YOU cant remove the slanderous and defaming post, THEY aren't going to give you your money back. So THAT particular ploy has failed from the moment that you hopped online. Perhaps instead of spending the time it took to make your post, your time may be better spent WORKING WITH THEM to resolve the gun issue.

Since you know that YOU gave away WHO you are to them the moment you told the entire world which of the buyers YOU were. So try and work it out with them because the path YOU are attempting to go down isn't going to go very far. Which would you rather have?? A WORKING weapon or a fancy new wall decoration?? All YOU have really done with YOUR complaint is give them MORE business. WHY?? You may ask. Because, the human creature is dumb as a stump. They have a fatalistic view where when something bad happens to SOMEONE ELSE, they ASSUME it will NEVER happen to them. Couple that with the inherent curiosity of human nature and BAM!!!!! MORE BUSINESS!!! And before you start....nope don't know them, don't work for them. ect ect ect. I say this ahead of time because YOU much like every other person who complains and whines online is going to ASSUME that ANYONE rebutting YOU MUST be the people YOU are complaining about. Im just a consumer like yourself. I just happen to be the one looking at the situation with ZERO vested interest in said situation.
