I have owned my home for 5 years the first 4 of that, I paid the dreaded ARM, on time. Even though it has steadily been rising. I have 2 loans with these people the bigger 1 is at 9% the smaller at 11%.

When the payment became to high I began this nightmare of the Loan Mod. That was 8 months ago. Now here I am 8 months later with nothing to show for it. I talk to ASC 3 to 4 times a week. I wish I was able to record the conversations as they do.

Here is a taste of what has been going on. It seems like I and apparently many others would have to be making up these horror stories. I can tell you first hand they are scary and true.

I faxed in the hardship letter, financial worksheet, proof of income and all that they asked for multiple times. I got confirmation they received them and was told to call back in 2 to 3 weeks for a response. I called back 2 weeks later only to be told that they didn't receive them. I sent them in again and again went through the confirmation and call back routine. This time I was denied for missing signature.

By this time their 60 day in review time frame had expired. I Started over and did this again and again. Meanwhile I'm getting letters that contradict what is being said by ASC employees on the phone. At one point I tried to make a payment and was told that if you were attempting a loan mod. they couldn't accept a payment and to put the money away tell your modification was done.

More recently I was told that I have a 1000$ surplus and was denied because of this and that I should be able to afford the present payments. My financial worksheet clearly shows me with a negative to zero balance each month.

March 10, 2009 I receive a letter asking for 4 new documents to complete my loan mod. Along with the originals they also want my Listing Agreement, Buyers Pre-Qualification Letter, Signed Purchase Contract/Est. Closing Statement, and Tax-Return. Sounds like ASC is missing some paperwork that they should have, once they bought my loan. Which was completely out of my hands. Could this company be anymore sketchy? Anyone who has to deal with them knows the answer to that.

I've been told my loan mod. is closed and that 2 liens have been placed on my home. My negotiator Richard M Kerry says, this is not true and that my request is still open. He was going to ask his boss if he could get a verbal statement for my income. I haven't heard back from him yet. I don't have his number or a way to get a hold of this man. How am I supposed to move forward when I can't talk to the guy assigned to my case?

Just in the last week I have had 6 to 8 conversations with 4 different departments. Loss mitigation, manager resolution, The Negotiator, ASC's Hope Hot Line or whatever that is, and customer service.

Has anyone had success? Why is this company so unwilling or unable to help? Are they just making this up as they go along? Is Wells Fargo trying to collect on all these foreclosures in some way? Nick Broomfield,CO
