My stepfather purchased a home last year and the lender was America's Servicing Company (through broker). He has been ill and I have his power of attorney. I have faxed and mailed a copy of the power of attorney, as well as a letter to them that gives me the authority to act on his behalf. He has also given them verbal permission.

They continue to tell me, no matter how many times I send the info, that they have not received it and cannot answer any information about the account. My stepfather is in intensive care in critical condition and I have been trying to manage his business with them to pay his mortgage. They would not discuss any payment information with me, and I was questioning fees and an increased mortgage amount, but no one would answer.

They sent a 'demand' letter for two months plus fees that added up to more than the mortgage and late fees. In addition, they have raised the mortgage amount, but I cannot find out why. I was under the impression this was a 'fixed' conventional mortgage. I sent a Fedex to them with a check and another copy of the POA and letter, but they say they did not receive it -- yet again! I sent it to their 'escalated' fax line! When I call, I wait forever for someone to come to the phone and, half the time, I get a response that 'the person who can help you is not available right now'! I don't have the authority to make that decision.

When I ask...who does, they tell me there is no direct line to the decisionmaker! I asked them why they did not have a website for their clients to pay their mortgage and they responded that they 'were in the process'. A lame excuse for a website appeared a few days ago with a '2002' date on it. This is a farce and, I believe they purposely put up smokescreens in an effort to increase their opportunities to collect unnecessary fees from their clients. I paid the amount that they requested, even though I did not know what it was for and will probably have to pay the increased mortgage amount going forward since they will not speak to me about the increased rate and I do not want my stepfather to lose his home or his good credit.

I am a realtor and I consider this company to be shady at best. I would never encourage a client of mine to 'knowingly' do business with them. Unfortunately, a person has no control over who their mortgage is sold to!
