This is the 2nd time Americredit tried to repo my car- last time we let then get away with it- this time I got in the car and, thankfully, I called my attorney, who talked with the tow driver and told him to drop the car as it stood and get the heck out of there. The only reason I still have the car was I hightailed it down to my attorney's office and he was on the phone when I called them back.

My attorney is actually dealing with other issuses for me, not this, but he was a Dear and helped a friend!

The issues started really when they were calling me to get a payment andI was legitimately late. They had a computer calling me up to 8 times a day (even while I was at work-when I had asked them to call me after hours please)-so I set up a payment arrangement, changed the date of the payment arrangement- and they didn't change it- it pulled 3 days BEFORE the original arranged date and bounced 17 checks! A total of $1375 in bank charges. I was talking with Garrett Miller, manager, who assured me that he could call my bank and get them to take care of the fees...yeah- he did nothing! Then....

I had a verbal arrangement with them to do a deferral. This year has been horrific for us- my immediate family- husband, chidren and myself had 7 surgeries in the past 12 months that required hospitalization. My husband was out of work for 12 weeks, and i was off for 6. In addition, my father in law died, my Mother in Law was destitute without selling her house (which we just finished)- so I had LOTS of issues that could be considered for the deferral.

I had a verbal agrement with them that I would call them on Monday- I called Monday and asked what the absolute least amount of money I would have to come up with to do the referrral- I was told (by Joanna) that it was $629. This was at 5:30 pm, after the banks are closed in my town. I told her I would speam with my husband and I would cal lher in the morning with the info about the money. She said ok. At 8 am (before the banks opened)- the repo man was at the door- he knocked to ask for the keys. I called Joanna and asked what was going on- I had just spoke with her- and she said there was nothing I could do but let the man take the car. I told her I didn't even have time to get to the bank- it wasn't even open yet- she said he had to take the car.

Thankfully, something told me to get in the car. I did and called my attorney and he had the tow driver drop the car. The tow person gave me 48 hours to take care of it, before he was going to be back at my door-

And I went to see my attorney to have him be there when we were talking. He got to speak (on speaker phone) with Priscialla, a manager there. She quoted laws, which my attorney said was wrong- she told me I had to turn the vehicle over to her immediately or I was harboring mortgaged goods- he said I had no obligation to make it easy to get to while we were working this through-

Basically, when we were done with the phone call, he said he would do anything I wanted with the car- he said they weren't playing by the rules, so I had to protect myself.

Which I did. The final arrangement was made with Garret Miller, manager, supposedly. Garret had me pay the car up in full, $1370. Then he would honor the deferral for November and December 2008. I paid all of that money, even though that was my house payment- I needed a car to get to work, or I wouldn't have a job- let alone a house!

He wrote me an email that did say that he would call off the repo man as long as I paid all the cash by Friday of that week. I did.

And then I received a collection call on Monday for November's payment (due december 4th)-and that was supposed to be deferred! Of course, it was a computer-that didn't get to anyone at all.

I got another one today- and i was able to get a person this time. I went to another person- and he said there wasn't anything on ther deferral at all and Garret was on vacation! No kidding- like i said, no rules for them!

Finally, he said he would put a deferral through- yeah- it's not done...what a pain in the rear end!

I wish that life didn't treat us with these blows- but it does. And I wish there weren't these sharks out there- when you are having a bad time already- and people are being upfront and honest with you- telling you the truth- giving you supporting documentation supporting your issues-and they twist you until you bleed. then they lie and laugh about it afterwards! No kidding!
