A few month ago, I thought, its time to start checking my credit. I did, and then it started with asset acceptance all over it.  In 2003 I was served wiht papers for court, for a balance that was about $400 at the time in 2000.  The papers were for someone else, so I went to court, the judge through it out. Then after, since I started my enevour with checking my credit, I noticed two judgments on it from 2005 and 2006.  I had no idea of themm. I was never served.  On one court docket it said my husband signed for it, he said he never recieved anything. (we were seperated)



I called the credit counseling place, they said to send in a dipsute.  I did, and then the next month again, and the next, and then the Experiean, said I it is validated, and done, I cant dispute it.  WHat, I didnt know about this, so therefore I can dispute it. Then I started noticing odd emails, and strange text to my phone, inquiring on  my accoutns, I gave no info. Then since out of a job, I filled out some applications for a job, and oh boy, talk about letters, they started sending me letter after letter for making negotiating my accounts and settle this and that. I;m like, what is going on here. I started to think there was alink between these agencies that are to help you look for a job, selling your info. SO I looked at these so called debts, and they were from 10 years ago!!!, some not even on my credit report. Low and behold my husband got laid off last month, and ifnally we recieved his last check and unemployment check, we deposited fast, so we could pay our bills. He said, go grocery shopping so we can see what we will have left.  I went at 7P in line, my card doesnt go thorugh, again and again, then up to the head cashier, called the bank, after their apologies, im sorry the judge ordered your  account to be seized. WHat? who? me? (the one who is afraid to get a ticket)? yes maam, this is myhusbands account too, what about our bills? they will be returned. so we have no money? what about my insulin? you have no money, youll have to get a lawyer. with what? you just said I have no money? how is my husband in this? he is on the account. yes, but this is his money, not mine, but its ajoint account and your name is on it. so... they delivered it to the bank today at 4P , so when was I going to be told, and what is this for? asset acceptance, they are hodling it for $6000!, for what??? I never had credit for $6000, not even $2000. get a lawyer. I guess its time to move out of the USA, the rich get richer, and we rob the poor continually. I alwasy told my daughters, if you do good, and do the right thing, stay good, dont violate the laws, life will be good. PLEASE< I had to eat those words for dinner. as for tomorrow, I will have to think of how to feed my kids, as she worries why is mommy crying, and why I have to explain to my husband, that his adorable wife, is like a convict now. Not a smoker, drinker, not even a curse word. ALways giving her last dollar away, is now thinking about the sign on the road, and how there are no rights for us americans here. I will never ever use a bank again, and funny, my boss told me that 3 years ago, never use a bank he said. use cash for everything, your being tracked, little did I know its true. EVen last month uncle sam is holding my money from my husband not filing for $9K in 2005, but of course we were sperarted, so the 2009 filing is being held because he is on it. I'm moving to Greenland

Okay the "credit counseling place" should have told you more than just dispute it on your credit report.  Because a judgement is a more serious matter than just a bad item on your credit report..as you have found out.

The good news(if you can call it that) is that if you want to do a lot of the "leg work" you don't need a lawyer for most(if not all of it).  The first thing to do is go to the Clerk of the Court at the Courthouse the suits were filed in.  You need to get a copy of the Original Suit and more importantly the "Proof of Service".  There may be a charge for the copies, but it should be minimal.

If you can prove that you were not served correctly you can make a motion for the judgement to be vacated and the "attachment" lifted from your accounts.  Unfortunatly this is not instant and it will take some time to have your motion heard.  The amount of time would depend on how busy your courts are.

If you can prove that the Proof of Service was falsified then they can be in serious trouble and you may be able to go after them for damages.  Not to mention that if it was a lawyer or law firm that did that, you can report them to your States Bar association.

Now you didn't say that if these were valid debts or not.  But if they were valid debts the creditor may be able to re-file the suit.  But this time you would have your day in court.  However, with this company the chances that it was a vaild suit and that they have enough proof to prevail is probably very low.

As to your tax situation.  If you qualify you may want to look into the "Injured/Innocent Spouse" provisions of the tax code.  This could release your portion of any refund due to you as you would not be held responsible for your husbands actions.
