I wrote the Attorney General who turned my complaint over to the OCC. The Office of the Comptroller of the Currency. 1301 McKinney Street, Suite 3450 Houstan, Texas 77010 1-800-613-6743 The OCC is the Primary Regulator of National Banks. I received a letter today from B of A which reads. Dear Sir, On March 24,2004, We received an inquiry from the Office of the Comptroller of the Cuurency on your behalf. We appreciate the opportunity to research and respond to this inquiry. To research we went to Ms. Peggy Johnson in Recovery Management. Our records revealed two charge off accounts for a total of $299.39. Ms. Johnson has informed me that as a goodwill gesture, she is waiving the the charge off on these accounts and is requesting the reporting be deleted from chexsystems and the collection agency. Please allow approximately ten days for the records to be updated. I turst this letter has brought a satisfactory resolution to this matter. So Thank You OCC, and I guess in their own way B of A addmitted Fault. I hope all you that has been ripped off by B of A will write the OCC.

You state in your second post that your landlord submitted the check EARLY. You should be asking him or her for your bounced check and associated fees. While I'll agree it's frustrating for BOFA to keep re-submitting the check for payment, if you're 'close buddy,' the landlord, has submitted the check when he or she was supposed to, ALL this would have been avoided. 100% blame on your 'close buddy' in this case.

Michael, Maybe i should be more clear. My landlord deposited the rent check early to his bank, it got to b of a before the first so it bounced. B of A tried to cover that check with my savings, i had no money in savings, so they charged me to try to get that money out of savings. The next day it went back thru, my landlord didn't send it back thru B of A did. So each time B of A sent it back thru their system,it cost me $40.00. I don't think my landlord ever got the check back, when i saw what B of A was doing i paid my landlord cash. I told him if he got the check back to tear it up. We were pretty close and he never told me about getting the check back. If the system wasn't corrupt like it is then your right, my landlord would have gotten the check and possibaly resubmitted it. On top of all the fee's they charged me i couldn't even put a stop on my checking, and when its negitive they charge u daliy till they collect, after about a week they close it, but now u owe $220.

Whenever you present a check to a merchant it is that merchants right to go ahead and try to collect there money. If your check bounces it goes to the merchant and then its up to the merchant if they want to keep submitting that check to the bank until they get paid. That was your responsibility to make sure you have funds for that check....
