Was TWICE charged a $38 NSF fee for transactions that didn't actually result in a negative balance. Upon talking to customer service, I was told these fees were charged because of money that was being HELD by a restaurant. The restaurant was apparently holding $75 for a $21 transaction. When a later transaction was made, my balance went negative in their system, even though I actually still had a positive balance. The same thing happened to me a couple weeks prior. At the moment, I'm on hold with customer service. After I couldn't get a clear explanation from a representative I asked for a supervisor. I've been on hold for 30 minutes so far. Clearly, BBVA doesn't care about it's customers. I'll be moving my money somewhere that does. AVOID BBVA AT ALL COSTS!

...however..there is a problem with the "system" no doubt as you had no way of knowing the restaurant was holding any funds....but apparently the bank did. The customer service of this bank is questionable since you should not have been charged any fees or had to have spent so much time and resort to threats of closing the account to get those fess reversed. They should have never been charged.

Now I assume the bank that issued you the card did not inform you it was your responsibility to ask any merchants that accepts the card if they are going to put any unauthorized "holds" on the card....but in all logic would assume the bank must have been asked or informed since they seemed to know about it. Kind of makes you wonder how the second NSF came to be...the transaction should have been declined if there were not enough funds to cover it.

I sense this bank might be a tad shady. Thank you for posting this warning.

After spending 45 minutes on hold, I decided to just give up and call back later. When I called back I threatened to leave and they promptly refunded my 2 wrongful NSF charges. My biggest problem with this whole situation is there is no way of knowing if a restaurant is holding your money on BBVA's website. Your current balance does not reflect any holds, and pending transactions only show actual charges. So even if you are responsible and keep a written ledger, you can still be hit with overdraft fees because of money that you didn't actually spend, but is being held.

Your problem isn't really with the bank.  It is with the Restaurant who said you were spending $75 when you only spent $21.

Now, you don't give any details as to where the charge comes from.  But there are cases where the restaurant may be wrong(and you possibly could go after them for the fees).

For example, the VISA merchant agreement strictly forbids restaurants from "over-authorizing" cards for estimated tips.   So if you were at the resturant, had a $21 meal, the amount held should have been $21.  Now that is VISA,  if your debit card is Master Card I believe they have the same policy but not sure if it is still in effect. 

However, if you were at a bar and just opened a "tab".  Then the $75 hold is valid because it is not for the estimated tip..but for purchases you are making on an ongoing basis while you are there.  This then falls on you for responsibility, as it is your responsibility to ask how much they will be holding for this.  Of course to avoid this all together..don't open a tab and just pay for your items as you go.

As for the Overdraft fee.  As far as the bank was concerned you were spending $75 because that is what the restaurant said you were spending.   So if that put you over per their policy then you would be charged fees.
