I took out this loan in July of '06, because like all of us, I fell on hard times. I wasn't sure if we were going to have rent because my b/f and I had separated. I wanted to make sure I had the money to pay another months rent and then get out. Well the b/f and I got back together again and now I have this cash call loan. So I made two payments then we had gotten pregnant.

I was so terribly sick and didn't care if the house I was in burned to the ground. So you can imagine I didn't care about this loan. I couldn't work and we survived on my b/f's pay and some school money. My bank account was closed because of overdrafts not connected with this. I supposed it ticked them off my account was no longer accessible. They also harassed my brother (he demanded they stop calling him and they did) and they called the place where I was working once. Anyway I ended up losing my pregnancy. After a couple months of grieving I realized I had to get proactive about my debt. Cash Call had been sending me settlement letters, but I ignored them (and just about everything else) because of what I had just went through.

Now all of this wasn't there fault, this I know. In February of '07 I decided to contact them through email. I got into a back and forth email argument with a Cash Call rep. I have all these emails still. I was trying to negotiate a payment plan to where I would pay $100.00 a month then more later when I could. Well for them that didn't suffice. They wanted $126.00. Can you believe that? They wouldn't lower the payment 26 bucks. She said it was unacceptable and that was the last of that. I did get a couple collections notices from an agency then that stupid summons on August 22nd.

So I plan to show up the the court date with my emails. I want to at least show that I tried working out a payment plan with them.

DON'T ignore the court date for ANY reason...if you don't show up they will get a default judgment against you. FYI: You can request a "motion for continuance" from the court. this is a fancy term for "postponing". The worst they can do is say no and it shows the collection agency that you know how to work within the system.
