Brought a 2008 Dodge Caliber On 4/14/2014. A week after I had the car, a warning light came on in the car. Took out the owners manual find out it's the electronic throttle. Basically it's the fuel not getting to the excelurator. Went to dodge for an oil change, upon visual inspection, car needs brakes, rotors, shocks, struts, wheel ailment, oil pan leak. And a few other things. Total cost to let dealer fix, $2200.00. Went back to the dealer, nothing of course is under warranty, and if I give him $1100.00 he'll fix everything. Now I'm ok with normal maintaince on a vehicle. Not $2200 worth. Owner peter was not willing to negotiate. Don't buy from these people. Going to court!!!

I did not see the written 30 day warranty information in your original post. Because you have a written 30 day warranty from the time you purchased the vehicle and the repair item is specifically covered under your warranty; then by all means, take the dealer to small claims court since he isn't willing to honor the warranty you purchased.

Make sure you document not only the cost to repair and the purchase agreement with the warranty, but also the dealership's refusal to repair in accordance with warranty terms and conditions. Should be an easy win for you in small claims since you have everything in writing and it is still in the warranty period.

The only caution I would offer you is this: if the warranty is a verbal one then get the dealer to commit to the warranty in writing before you file suit if you can do so. Otherwise, if the purchase contract specifies AS IS, and the warranty is verbal, it will be difficult to prevail in small claims as a verbal modification to a contract doesn't modify a written agreement. Car dealerships know that and use it against us consumers. Is it fair? No. That's why you can't trust anything a dealer says - it has to be in writing to be enforceable.

Why would I pay for any item covered by dealer 30 day warranty? Which he claims to know nothing about the item covered! No thanks!!! I'll take it to small claims court and then put.a lien on his business! I'm sure I'm not that first!#

You seem confused about the duties of vehicle ownership. Check your purchase agreement. If you have a warranty for the vehicle then check the coverage for your warranty.

It is not the dealers responsiblity to maintain the vehicle after you purchase it. It is your responsibility. Usually a used vehicle that old would not have a warranty at all unless you specifically paid for it at the time of purchase. Now that you know what is wrong with the Dodge, take it to a good local mechanic to get the repairs done rather than to the Dodge dealership. Taking it to the large Dodge dealership is one way to pay the absolute highest amount for mechanical repair. Taking it back to the dealer where you purchased it is not a good idea either as they will bandaid together the repairs rather than fixing it the right way just to get you out of their shop. Locate a good mechanic and use him wisely. You will have better running vehicles for less money spent on repairs. Good luck.
