I took a case against Wells Fargo Mortgage to Small Claims Court in Fallon Nevada.
The suit claimed that Wells Fargo Mortgage issued a refund check to the wrong person that should have been issued to me.
None of this was in question and the evidence was against Wells Fargo Mortgage. They messed up, big time.
Legally they were liable to me for the amount of the mis-directed funds but claimed I would have to collect from the other party, the person they sent the funds to.
In so much they errored they were legally responsible to reimburse me.
When I went to Court I assumed that my case would be heard by a real Judge. To my suprise this Judge, and I use that term losley, was a Justice of the peace. An Ex-Police officer who ran for office and was elected. Had no legal background other than writing traffic tickets.
Of course he found in the favor of Wells Fargo Mortgage with a ruling that I was persuing the wrong party. Their words exactly.
I later found out that here in Nevada anyone can be a Justice of the peace and make decisions regarding peoples lives by only taking a short informal class as to how to administer the law.
It seems that many of Judge Ward's decisions go in the favor of businesses.
This guy has no business making decisions about peoples financial and personal lives since he has no idea as to the rules of law.
