Complaint Review: datingpsychos.com (Brian Fitzgerald) - Los Angeles California

I sued Brian Scott Fitzgerald for $5, 000 and won. My case was heard in California on 15 August 2013. Brian did not show up, although the Judge deemed he was successfully served because his business partner alerted him about the hearing in an email that I was cc'd in, and Brian responded to that email, thus satisfying the Judge he had been notified. Brian however ignored my attempts to settle before the hearing, sent to that same email address. 

The Judge considered fully the Communications Decency Act or CDA, 47 U.S.C 230 and concluded that because Brian himself had re-posted an untrue, libellous statement about me that he had pulled from another site, he was both the publisher and the host, and as such he was the one guilty of libel. There was also the discussion of blackmail and racketeering. 

If anyone wants more info I'd be happy to provide it, as I imagine this will open the floodgates of other successful lawsuits.

After long time searching and digging and praying, I've finally found out who the owner of datingpsychos.com is. If you remember, this guy posts up and encourages others to post up horrible profiles of other people. When the slandered individual finds his or her profile on the website and asks to have it taken down, the owner charges them $100
through paypal to have their name removed. There are literally thousandsof profiles online so this guy must be stealing thousands of dollars every month by bribes slander and extortion.

Doing a search online, he has been at it for several years and is still running this site. All the threats of lawsuit obviously haven't panned out and he gets away with numerous crimes month after month. Who knows what horrible crimes his website has lead to over the years.

The domain is registered at godaddy and displays his information. It has been private for a long time so perhaps this is a small window of opportunity ... so I took a picture just in case.

I have no idea how to get this site shut down. Nothing seems to work. Do you have resources or suggestions on what to do? I wish to stay unknown as I don't want my name to show up on the website again. It caused manyproblems for me in my life.

Here is all I have to say about this guy in Virginia CLAIMING that his profile at "DATINGPSYCHOS.COM" was removed:      

THE SAME VIRGINIA PERSON CONTACTED US TO JOIN OUR LAWSUIT AND NEVER DID, AND EMAILED US LOOKING FOR INFO ON THE LAWSUIT.  THEY EMAILED:   [email protected] in order to ask questions but never followed up with us and never gave us credible link to the post on DatingPsychos.com they were defamed with, and never joined the class action lawsuit.  So what does this mean?  WE DON"T KNOW what it means.  Is it LEGIT?  Don't know.    Here is why we have our suspicions that this person is actually Brian Fitzgerald POSTING as a victim.    1.  This Virginia man said he talked to "Pat"..........well we have had many people threatened from someone at DatingPsychos.com who refers to himself as "Pat McGroin".....a funny name if it wasn't connected to such a serious criminal extortionist enterprise as DatingPsychos.com   2.  Brian Fitzgerald uses "Pat" as an alias.  3.  Why did "Pat" erase this message and nobody else's??  Pat just happened to HELP this Virginia person, but didn't help ANYBODY else?  Why would "Pat" aka; Brian Fitzgerald, all of a sudden grow a conscious just for the poor Virginia victim.  UNLIKELY!!

So we're not saying this Virginia person is not 100% legit, it just sounds a little bit fishy, considering all we know about Brian Fitzgerald's scams.  And one of his biggest scams is to engage you in conversation and post all sorts of FAKE things, like his dissertation about how they are protected by internet common law regarding 3rd party posting liability/ free speech.  HE LIES-- they are NOT protected.  PLAIN and SIMPLE< he makes things up.  And they sound official and true but they are not.  We found him finally.  We have surveillance camera and photos of him now.  We found him.  And he does not like how quietly and efficiently we've now inserted ourselves into his life.

It would have been a lot easier to VERIFY this Virginia person if they had cooperated with us.  If they would have given their name to us.  We did NOT receive anything from this Virginia person, so it's another missed opportunity to know what is going on.  I suspect it's Fitzgerald trying to lull everybody to sleep again.............but we're not sleeping Brian, we're watching.  And filming.

I finally got a response from the web team at Datingpsychos.com after many attempts to have them remove the lies posted about me on their site. "Pat" contacted me and removed the slanderous profile of me on their site and never asked me to pay them anything. They did ask me to remove this post which I cannot do, but I am happy to report they complied with my request. I only hope that decide to shut down their site as it only serves to hurt people and provide a vicious avenue for bitter individuals to hurt others.

I am in full agreement with all the accusations against datingpsychos.com This site needs to be removed and the owners need to be arrested and convicted of dafamation of character and liable. I will assist anyone in any way I can to see that those involved with datingpsychos.com are brought to justice!

Dear person that found Fitzgerald and posted the Hassman Fitgerald Entertainment: You are awesome.  It's about time someone stepped up.  And THANK YOU for the hosting info.

These guys have evaded service process for a loooooooong time.  And now we're close to getting a "must appear in court" service on them.   If they are soooooooooooo straight and narrow, why are they NOT making their whereabouts known?   

At this point I don't blame them for hiding, they've hurt a lot of people, tarnished a lot of characters, and angered more people than I can count.

About Dating Psychos...........

You say they are letting people falsely accuse people? Yet this website is an interactive reputation management website and cannot possibly monitor the accuracy of information which the users may choose to post.

Just as Rip Off Report says itself - "Making interactive computer services and their users liable for the speech of third parties would severely restrict the information available on the internet.)

If you took the time to e-mail Pat or whoever is now running Dating Psychos and ask them for your information to be removed, then you would clearly understand that you do NOT have to pay anything to have your profile removed. However, I can appreciate the fact that all the money that does get donated, goes to a great charity.

Do you have problem with a domestic violence charity? Did you ever ask anyone to remove your profile?

If you are considering suing a site like datingpsychos.com because of a profile that you claim is defamatory, you should be aware that there is a federal law called the Communications Decency Act or CDA, 47 U.S.C 230.

The CDA is part of our federal laws. Search on Wikipedia for it.

The CDA provides that when a use writes and posts material on an interactive website such as datingpsychos.com, the site itself cannot, be held legally responsible for the posted material.

Because the profiles on datingpsychos.com are authored by users of the site, they cannot be legally regarded as the publisher or speaker of the profiles contained and hence are not liable for profiles even if they contain false or inaccurate information.

This sam law applies to Dating Psychos, Facebook, Myspace, Craigslist and even this site here Rip Off Report. Users who post information on these sites are responsible for what they write, but the operators of the sites are not.
