I sought services from Earth Mortgage in early October, 2006 for a loan to refinance property. Based on factual information that was given to Senior Loan Consultant, David Stahl, such as credit score, income, length of time with current employer and other pertinent information on the loan application, I was told that I was pre-approved for a loan program with an interest rate of 6.375%, paying 1 point, requiring no money down, no assets and no seasoned funds for the combined total of a first and second mortgage totaling approximately $410,000.

Having been told that certain extenuating circumstances would necessitate closing prior to Novembers mortgage being due, Mr. Stahl promised to get the loan closed prior to that date. He also indicated that he would refund the $300 appraisal fee and reimburse any expenses that we incurred as a result of not closing prior to November 1, 2006.

Knowing that the real estate market is currently in a weak state, I expressed concerns to Mr. Stahl about fears of a low appraisal potentially changing the loan product he was promising. Mr Stahl indicated on several occasions that he "had control over the appraisal" and that I need not worry about it coming in low. He stated that he had "connections" with several appraisers in the industry who will "place whatever value he tells them on an appraisal" in order for the loan to go through as promised.

At the same time I was talking to Earth Mortgage I also inquired about a refinance package with Meridian Mortgage for a comparison. When we presented Mr. Stahl's product to Meridian Mortgage they stressed that the offer was bogus and that I should tread carefully as the deal will change drastically, not in our favor, at closing. Meridian told me that Mr. Stahl was "hard selling" a product that he could never deliver and I should expect quite a different product at the closing table. I was quite up-front with Mr. Stahl about the communication I had with Meridian Mortgage and again, he assured me that he was honest and could give references of other Earth Mortgage clients that he recently closed similar loans for with the same criteria. His pitch and promise to close the loan, exactly as he stated, was convincing enough for me to move forward with obtaining the loan through Earth Mortgage.

I was told that the loan was "pre-approved" based on factual data given on the application and accessed through credit reports and that nothing at all would change the loan product going forward. I gave Mr. Stahl $300 on October 10, 2006 for the appraisal to be ordered. The next several months proved to be emotional, time consuming, expensive and unfair.

Two appraisals were done and neither of them came in at the value Mr Stahl needed in order for the original loan product to work. His claim to have "control" over this process was obviously false and caused great stress, time taken away from work and financial loss. Despite Mr. Stahl's insistence that the loan would go through as planned and that the appraisal would never stand in the way of it, the loan product changed drastically. As a result, the new mortgage payment is much higher than originally promised; there are two loans instead of one and a very high interest rate on the second loan causing a much higher monthly mortgage payment going forward-- $300 more per month than originally promised.

I had been in touch with Frank Cortese, the president of Earth Mortgage. Not once did he respond to my complaints about Dave Stahl's fraudulent and dishonest practice. Well, not until I e-mailed him a copy of my BBB report. He then responded with blatant lies in reference to the loan, harassing me via e-mail when I asked him to stop e-mailing me! He claimed that I had never disclosed a second mortgage to Mr. Stahl at the time of application! That is pure BULL!

My BBB complaint demands reimbursement of late fee's on our mortgage from the loan process dragging out for 3+ months, 6 credit reports inquires later and a lot of other stress. It also demands a settlement fee of $20,000, which is only a fraction of what will amount to thousands and thousands of dollars to pay on a split mortgage, one of which has a 10.75% interest rate, payable in 15 years. It's pathetic that Earth Mortgage will likely get away with ripping me off and many more people down the road. I wish I had trusted and listened to Meridian Mortgage. They knew from the start all the exact same data Earth Mortgage knew. They not only predicted but guaranteed we were going to be screwed by Earth Mortgage based on all the same exact information that was given to them. But Mr. Stahl seemed so trusting over the phone, even saying at one point that he would come personally to Massachusetts from Texas to get our loan closed as originally promised. Now to defend their lies they are literally making things about our loan and what was/was not told to them! I expect a rebuttal that is completely distorted, dishonest mad corrupt!

It's infuriating to think that Earth Mortgage can continue to function in a corrupt manner, manipulate a consumer and get away with it! Not to mention operate a mortgage company in a criminal fashion, manipulating appraisals along the way!

I actually take the time to answer these claims because I believe that you the public MUST REALLY know what is going on. This client claimed their home was worth $150,000 more than the appraised value. Simple Put They got pissed off at Earth MOrtgage for the low value and their rate changed due to the higher LTV. Please do not believe everything that you read!

Frank, I know this isn't the first complaint you've heard about deceptive practices within your shop. How you can stand here and call the end customer a liar, without knowing what was said on he phone is completely beyond me. My experience echos the experience of the above consumer - WAY late to close, not due to consumer or 3rd party issues, promises to pay any associated fees that might be generated by that the time overrun that aren't followed up on. I know and can that such was my experience. You know that consumers get locked in towards the end of a close date and often are out of options. Consumers - do your homework with this company.. They may do may legitmate services, but there is a history of deceptive complaints. Don't believe *anything*

Public Read this insanity, these people have issues. They made up lies and they are wrong. I also have paperwork that proves they both misrepresented the entire value. I never fight with clients, I usually just resolve MINOR issues. They have gone to far, we wasted many hours laboring over this mortgage and I wish I just had Earth Mortgage walk away! I feel for the mortgage company that has to deal with you in the future! Have a good life and STOP misrepresenting your PROPERTY!

Guys, We're done with this bull. We have reported you to the FEDERAL TRADE COMMISSION and realized you have already been reported before on various occasions. I am personally shocked (although I shouldn't be) to read what the two of you have written here. You are making everything up to save your *ss. I hope you can sleep at night! WE MADE HALF OF WHAT WE WOULD OF MADE ON THIS LOAN IF THE ORIGINAL INFORMATION PROVIDED WAS CORRECT. WE SPENT 2 MONTHS TRYING TO CLOSE THIS DISASTER! I REQUESTED 3 TIMES TO REFUND THE CLIENT IF THEY WOULD GO SOMEWHERE ELSE. YOU DID A CASHOUT MORTGAGE AT OVER A 85% LOAN TO VALUE, WHEN ORIGINALLY YOU CLAIMED IT WAS LESS THAN 70%.. READERS- PLEASE CALL ANY MORTGAGE COMPANY AND ASK THEM IF THE RATE IS THE SAME FOR A 70% CAHSOUT MORTGAGE OR A 86% CASHOUT MORTGAGE. IT'S NOT, PLAIN AND SIMPLE!

Frank, Your rebuttal is a bunch of lies. My ex-wife facilitated the loan process for me while I was working a million hours. I never once apologized to you about her. That's just another lie, which you are obviously very good at. In fact, the scenario is quite the opposite of what you claim it to be. Robin worked diligently to get this loan for me so I could settle back into the house I built for my family before our divorce. Your original promise to make that work for me seemed quite unbelievable to me but I was excited when she called to tell me of Dave's insistence that he could make it work. The weak market and anticipation of a low appraisal was what concerned us the most. But Dave assured us that this was not a worry and that Earth Mortgage had appraisers with whom they had some control over and the loan would work exactly as he stated over and over to her. Instead, the loan turned into one that seemed corrupt and unreasonable. I wanted out of it and she pushed to make it happen, knowing it's what was best for me and the kids. Earth mortgage had all of my application information and credit information prior to even getting things going. So you are also lying on that note. And, neither my ex-wife nor I overestimated the home value. In fact, as I said...we told you we thought a new appraisal would come in too low. Dave assured my ex-wife and I that we didn't have to worry about that since your company has control over real estate appraisals. Again, this was a point I wasn't comfortable with and realized we were dealing with a crooked company. Frank, I hope our communications about this situation helps other consumers avoid getting screwed like we did. I'm not clear on how the federal government doesn't pick up on the Earth Mortgage's of the world sooner.

Frank, Not only can I offer a rebuttal that will claim you are a liar, I have the paperwork-- BLACK AND WHITE-- that can prove that we were upfront about EVERYTHING on the application. I told you: 1. The house appraised at $435K last year. Dave Stahl told us we needed a $450K+ appraisal and I feared we wouldn't make that given the weak market. HIS WORDS, "I HAVE CONTROL OVER THAT, DON'T WORRY AT ALL." He told me this a number of times and in fact, I called Meridian Mortgage and told them as well. They were appalled and told me it was corrupt for a mortgage company to function this way. 2. When we called Earth Mortgage, I had a credit report of my Ex-Husbands in my hands. I knew his FICO score and all the details about his credit. Mr. Stahl knew every single detail about past credit history. 3. Duh! What are you talking about that I didn't inform you of a second mortgage on the home? First of all you insisted in drawing a credit report PRIOR to presenting a program to us! LOL You are stubbing your toes on this one Frank. The whole reason for the refi was to roll in the second mortgage, get my name off the first, which would allow my Ex-husband to live with a more comfortable payment. This point you make is not only a lie but one that is obviously making you look really bad. 4. Dave Stahl knew this wasn't anything close to a cash out! Pure lies. 5. We were NEVER offered a refund! Again, lies! 6. My Ex-husband and I are friends and he is laughing at you right now as well. He will take pleasure in posting here as a response to yet another lie Frank. And yes, you are right about one thing that I am nowhere on the new loan. My name was taken off both mortgages to make our divorce process final. Interestingly enough, Earth Mortgage never once asked to talk with my ex-husband until I expressed anger about the loan changing into something completely different than we were originally promised! The loan application was submitted by me on his behalf and it was only after my confrontation with you that you tapped into communication with him! 7. Frank, we have all the original paperwork with the promises in black and white and all the information we disclosed to you upfront, which you said we didn't disclose. How you will ever remain in business is beyond me. I hope to God that more customers see your track record on the Internet and it will all help them avoid such criminals as EARTH MORTGAGE! Hopefully all will come out in the wash with this horrendous situation. There will be further investigation of the matter because I'm not into being screwed, nor is my Ex-husband!

First of all, what she wrote show be a hollywood movie bucause it is all FALSE!!!!!!!! Unfortunately in life we all experience people that have nothing better to do than cause greif in everyones else's life. This is an EX-WIFE of one of Earth Mortgage clients. She is nowhere on the loan whatsoever. When we first started this mortgage, this lady said that she would be part of this loan she also claimed that her house was worth $100,000 more than the actual apprased value. The great thing about mortgage business is that WE ALL USE OUTSIDE CONTRACTORS to do the appraisals. We have absolutely no say whatsoever on appraisals! So 1) The house was represented to us incorrectly 2) The credit was claimed to be perfect, it is NOT! 3) She did NOT inform us of a second mortgage that was on this home as a CASH OUT! Cashouts are a completely different loan. I offered to refund the client, her EX husband insisted that we continue with the process and appoligized about his exwife. We did this mortgage even though I did not want to. There were too many different stories painted and unfortunately lying to your mortgatge company is not a smart thing to do, especially when it will be discovered. Mortgage Companies please stand clear of this client, she is BAD NEWS!
