Contact your state attorney general's office and advise them of the situation. Also, I would get your cancelled checks or copies of the payments which you made (via bank statement). Then, ask EMC mortgage for a payment record. Now, EMC will try to pretend that they did not apply until a certain date, but remember the date on the back of the check does not lie. The checks are usually sent to the bank the same day received (that is smart business sense). Most companies will not want their receivables (money due them) on float (waiting to be deposited). So, once you have that information, then you will easily be able to present to the attorney general's office and also to them to show how they are ripping you off..
