My wife rented a Uhaul truck to move our stuff from GA to CA.  While she was on the 5 freeway heading south, a truck was doing 75 miles an hour and took the mirror off of her truck.  They both pulled over and exchanged information and kept going with no police benig involved.  We had purchased insurance through Uhaul so our damage to the truck was covered.  We suddenly get a letter from Enterprise stating that we had to pay the damage to their vehicle.  Their investigation which consisted of his statement vs. my wifes statement.  He stated that they were on a street and she pulled out in front of them and caused the damage.  That is hard to do with a 26 food truck towing a car and by the way they were on a freeway not a surface street.  So Enterprise sends a threatining letter stating that we owe the damage and that if we don't pay 419.83 they will take us to court and or send it to collections runing our credit.

I don't know how they can claim that it is our fault when they have no accident reconstruction specialist on their staff.  They did not go to the scene of the accident as they only took the written statement from their driver.  There was no report of fault from California Highway Patrol (CHP) or any local law enforcement agency.  I don't know how they can get away with this bully tactic to rob us of almost 420 dollars.  I want to take it to court but this will cost us much more than the money that they are trying to claim and we can't afford a crazy drawn out legal battle.  I don't know what to do, but this is a horrible injustice as I know I am not the only one that this has happened to.  There is no insurance that we could have purchased through Uhaul to cover this as it was their fault..or at least 50/50 and we paid our damage to our truck with the insurance purchased.  This is horrible.
