Fifth Third Bank, why can't I get a answer, call back, or fax of my requests. I returned an auto lease, on time with no extra miles, a clean suv, on Nov 2002. The dealership was happly with the return condition of the suv.

Then march of 2003 I get a letter from Fifth Third for damages. I was shocked to hear and read the report from a auto auction stating than the car was a wreck and it did not sell for a good price and I'm to pay for the damages.

I called the bank to ask where this car was for 4 months,and no one could or cared, only that I owned them money. I wanted a copy of my lease statement to see this provision of obligation and never got it. I wanted photos of the damage and better answers but no responds. They could only read of clue cards stating I own them money. I got a laywer to talk to them, and he got the same responds, the lease agreement is the law and please pay up.

I have not paid a cent to the bank wanting to talk to someone who can talk with out clue cards with no responds.

Now the bank has opened a Bankcard account without my knowing or requesting and charging the amount on the card. This Bank even has its own collection agency with in it self to attemp to collect debts. The collection agency all so read clue cards right from the bank. I believe this is against all known laws in this state, and when I asked the collection agency about this, all they can say is, yes we can and pay up. This is one hell of a way to scam people.

This sounds like a very bad experience. I might suggest that you find out who does the inspections for the bank. USUALLY the dealer is not the one who does the inspections. If you can find out who does the inspections, you most likely can access a website to view a copy of your inspection report. Another option would be to have the dealer that you returned the vehicle to sign an affidavit as to the condition of the vehicle when you returned it. I would suggest doing all of this in writing since it seems that they are being unresponsive by phone. About the bank card... Make very sure that you haven't signed anything authorizing this and then if you are sure you haven't.. contact the credit bureau and dispute the account under fraud. If the credit bureau sides with you for the account being fraudulent, SUE THEM!!! Sounds like you have a lawyer, so hopefully you two can get some results GOOD LUCK!
