I had leased a 2002 Ford Explorer and everything was going fine with payments until I got involved with a court case with Ex-Mother to my two kids with her. I immediately informed FMC that I would be a few days late each month with the payment while I pay my attorney to handle my court case the representative advised me that she was noting the account and that would be fine.

Like clock work the day-after the payment was originally due someone from Ford Collections would be calling me stating that the payment was late and that I was driving a car that does not belong to me at this point since the payment was not there. I told the representative that can she read the notes that I had put on their system and gave the date she advise it does not show me calling them at all nor speaking to a Representative. I advised FMC on numerous occassions that my outbound and inbound calls are tracked and I get a listing of the numbers calling me & and that I call out to.

But to get to the point on June 27,2004 FMC had my car towed away for supposedly 1month payment past-due which was made on the website: fordcredit.com. When the car was towed I immediately called Ford Motor Credit and advise the Representative that the payment was made on their website and that the should contact the tow company and advise them of the fact. The Representative advise me thanks for the raise he will see me in Court for the remainder of the lease. The tow company driver also called me to tell me to bad for my personal stuff in the car it was his.

A month later I received a letter advising me that they were going to sell my car at auction and that once they did I would get a balance due statement. A week after that I received a subpeona advising me their are sueing me for the full remainder of the lease $7,265.10.
