Did they continue to send you statements after you dropped to zero. If they did, then they can correctly assert the account wasn't closed. But, if they stopped sending statements, you can make a pretty good argument that they transacted against a closed account.

that reaches an exact zero dollars balance. I had an account with them and withdrew to a zero balance then deposited a check and a few days later discovered after writing a check that my account had been closed when I withdrew to a zero balance. I did not close the account - Hibernia closed it. I did not want to close the account - Hibernia assumed I wanted to close it. I had them reopen it but they explained to me that since it had gone to a zero balance, they thought I meant to close it. That was six years ago and I will never do business with them again for numerous reasons. Then I had an account with Hancock Bank and was moving to Georgia so I purposely took it to a zero balance thinking I was closing it since that had happened with Hibernia. Eleven months later, I moved back to Louisiana and went to Hancock to open a new account and was surprised that my old account was still open. They leave zero balance accounts open for 12 months after the date the balance becomes zero so I didn't have to open a new account and my old debit card was still good so I didn't have to wait to get a new one in the mail. Hibernia should never have assumed anything. Now I bank with the Exxon credit union and I can't see myself ever using anything but a credit union ever again.

Did you close your account in writing? Do you have a final statement from them that states 'ACCOUNT CLOSED'? If so, just send them a registered letter that the AOL transaction was fraudulent and unauthorized, ask them to rebate the charge and the fees, and to update you in writing that the CHEX entry has been corrected, and your account closed. But... if you just drew down your account and assumed that it was automatically closed, you may be liable for this charge, and your only resort is with AOL... and good luck with them!
