Mr Martinez, of HMA, was hired as a subcontractor to remodel my kitchen which included building new cabinets and a pass-through bar and paint the interior of my house. After 3 months of work, he disappeared leaving the kitchen unusable. He was granted access to my house and had been given a copy of a key to perform work while I was at work. The work was never completed and was performed to a horrible quality. No cabinet doors were ever delivered. At another time, he tried to withhold the money that I had given him for the plumber because him and the plumber were having a personal disagreement - unrelated to my job.

During his last visit to my house, he stole my ladder from inside my house. I have since had to hire a new contractor to continue the work, which to a large degree involved replacing much of the work that Mr Martinez had performed. This was due to the cabinets that were built not even being square, all of the edges being rough and not straight. He also damaged my hardwood floors in the kitchen and in the dining room below the window that was built (when a tool was dropped). A painter was also hired to complete all of the painting in the house and kitchen.

I have filed a complaint with the Austin Police Dept, and they are currently looking into fraud and theft charges against Mr. Martinez. I have been trying to contact Mr Martinez since August. I'm ended up having to pay an extra $3000 to fix and finish the work that he had done.

Generally when one doesn't want to compete, they don't post a rebuttal. A report was filed with the Austin Police Dept back in Sept, in addition, there is a report regarding fraud. Mr Martinez has stolen from other customers, who also have reports filed with APD for both theft and fraud. He even put a fraudulent lien against one customer's house who had no remaining balance. Of course he has not sent text messages or calls to customers as he seems to be trying to ignore these angry customers. The detective who was originally assigned to the theft case left several messages, however was never even able to get a hold of him. It was originally believed that the theft of the ladder was accidental, and that upon packing up their things it was taken. When I asked about this in a non-accusational way I was told that it would be returned by the end of the week. It was never returned. As for the reason for repeated calls - aside from me being out an extra $3000 for having to get another company to tear down the work performed by these guys and redo it so that it actually had some quality, my hardwood floors were quite damaged throughout my kitchen and even at one part in the dining room - I wanted to get repaid for the costs incurred. Should I have not done that? Perhaps. However, communication with this company ceased immediately once they requested. They even left a huge trash pile consisting of broken tile, old cabinets, sheetrock and nails sitting on my driveway that I had to get someone else to remove. I am more than willing to provide any photographs (I have plenty) of the "finished" project to show the type of quality that was performed, in addition of names and numbers of professional cabinet makers and painters that I would highly recommend. The contractors who came to fix the cabinets practically laughed when they saw the quality, and to be quite frank, if I were looking for that kind of quality I might as well have just built them myself. I would think that for professionals it would be quite easy to to get cabinets that are at least square and have straight edges, or for shelves to actually be level and flat - either I am sadly mistaken or these guys are not professionals. Use them at your own risk.

Sadly I will not try and compete with this sick person , lets leave it as it is , I have not text messaged or called a customer or anyone at all hours of the night and day 40 TO 50 TIMES AT A TIME ! If we stole a ladder why did he not file a report for this reason he states this customer has with no legitimate reason to harrass he has a serious mental problem if we had a key to his home and if we stole a ladder...WHY?

Hugo Martinez is making up these facts. There has never been a report filed with the APD police report that while his crew was working I was drunk trying to commit suicide. This is absolutely absurd - I have never tried to commit suicide! There was a morning that the contractor came to my house on a weekend to pick up a check (not Hugo nor any of his crew) and I was intoxicated. The ladder had originally been kept on the back porch, that is correct, however, it was moved to the inside of my house by Mr Martinez, where it stayed. Upon his last visit to my house it was no longer there. When I confronted him about the ladder over the phone, he agreed that he would return it. He also admitted this to the contractor for which Mr Martinez was the subcontractor. If the reason that Mr Martinez was in fact that he thought that I had mental problems then I would like to know why the remaining money was not refunded. And why for times when he would come over we would have many good conversations before her first disappeared. Mr Martinez continued to work on my house for 4 months after the morning that FRIENDS saw me intoxicated. However, he did not show up with a crew, because according to the contractor, he had fired them. He has tried to make the claim that he has "saved" me money, however "saving me money" for a plumber or an electrician was never part of the contract signed with the contractor. It was a fixed bid project for which I had mistakenly paid too much up front. The contract signed did not include "bonuses" or "attaboys" for saving me money. However, while we are discussing the facts, the "extra outlet" that Mr Martinez got, I ended up paying acround 600 for total. I had an estimate from another electrician and it was $800. That is not a huge savings like he is trying to make this sound like. I have sent Mr Martinez repeated text messages because he refuses respond back. The last time I spoke with him, he told me he would call me back - I have never heard back from him. Never once have I been told to not contact him. However, I do take this message now, as his request to no longer contact him.

This customer has filed this report with a possible vendetta cause , I refused to continue to do any work for him because of his personal problems , that resulted in him trying to committ suicide , there is a police report filed by the Austin Police dept that while we were working at his home one morning he was drunk , laying in his front yard with a gun inserted in his mouth , I and the company I was helping to repair hs home decided to let him resolve his personal problems ,we slowed the progress on his repairs in order to let him seek professional help , yes I did have problems with a plumber and a electrician that wanted to charge him $3000.00 for a extra outlet in his utility and I got it done for $200.00 and the plumber owed another customer over $2000.00 of which I was trying to collect for that customer and I have a signed and notarized statement from that person claiming that was the reason I had trouble from the plumber , this customer David has harrassed me for a ladder he kept on his back porch outside of his home , he has text messaged me at times for over 40 times ,of which I responded once and told him I did not have his ladder which costs $45.00 at Home Depot , I did not have a contract with him to do the repairs on his job nor did I work for him personally ,I got to know him during the time we worked at his home ,at this time I am seeking legal help in order to stop his harrassment over something I had no control over and I have references from past customers that can attest that I have taken care of thier projects in a good and timely matter.
