I will no longer buy hosting accounts at Hostgator because bogus un-investigated DMCA complaints were filed on me and hostgator (despite talking with security over the phone) failed to recognize, even with proof that the complaints were bogus with evidence submitted. This is bad business and actually against the law where they removed my account based on "a number of complaints" (they claim) after proving to security, the guy filed multiple complaints just to get my account pulled.

Hostgator pulled my account after hosting with them for over 5 years which was against the law when the so called complaint(s) did not warrant even a challenge or counter notice. After talking with security over the phone that admitted he had no power to turn the account back on, I was then told to email feedback@hostgator by the so called security team to provide all the evidence once again and label the message "repeal" so that a higher up can look at the account, in which there was no response to the evidence provided in a return email I got 7 days later stating that the account was not going to be restored because of too many DMCA complaints (can some random emailer just do this???).

I will not be coming back to hostgator based on their DMCA practices. They have both unskilled security and no paitence to investigate account issues. Never do business with a hosting company like this, and after 5 years of doing business with them I would think they would actually put the time into an account to see what was going on. The DMCA material wasn't even copyrighted and the person filing the fake complaints is (ASPKIN) name Donny Fonseca, using a fake address of: 8111 Mainland, STE 104-411, San Antonio, TX, 78250.

I should have filed a complaint with the downstream partner network solutions on Hostgator but I tried to give them the chance to see the error and hostgator failed me. I will no longer promote or tell people to use or buy hosting based on this outcome.

I feel I should get a refund on the account based on hostgator's mistake in following US DMCA laws but they refuse stating that they don't give refunds in their TOS. The law does not state that an account should be pulled based on the number of DMCA violations but only on the content. The hosting company in this case (a re-seller) has an obligation to investigate such claims according to the law and hostgator failed to do this, for I feel this is not my fault and I should be granted that prorated refund by the company.
