I had purchased a car from JD Byrider 2 years ago and it was the biggest mistake of my life! I had just left my husband of 7 years and filed bankruptcy for the debt that he caused. I had no choice but to purchase a car from them.

I should have known what type of company this was when they REFUSED to tell me a price for cars on the lot! They also REFUSED to let me put down a larger down payemnt in order to get the vehicle I wanted!! I was 8 months pregnant at the time and arrived at 7am to the so called dealership. I finally signed the paperwork at 9 PM!! After all that time they then informed me that I had to watch a video in order to purchase the car.

Since I was so pregnant, hungry, and completely frustrated about how long they took to sell me a car, I declined the video and went on my way in my new piece of junk.

I had that car in the shop for almost 3 weeks right after I purchased it and they refused to take it back. I was calling every day and begging them to just take the thing, but they wouldn't.

6 months into my payments, I was hospitalized and called the manager from the hospital and explained the situation. He told me not to worry about it and to make the payments when I was released. The day I was released, I drove home to get my checkbook and stuff to go make the payment. By the time I came out of the house not even 20 minutes later, they were repossesing my car!!

They refused to let me pay the 1 payment I missed because i was in the hospital and demanded that I pay the remaining $4,000 balance on the car in order to get it back. I should have done it because that $4,000 is now up to $11,000 that I owe them. They are taking $400 a month out of my paycheck for the garnishment. Almost all of the money is going to intrest that is still being added daily! I can not afford to buy food, pay rent, and struggle just for gas to get to work. Unfortunately, I can not get any public assistance because I make too much money. I guess they do not take into account that between taxes and this garnishment, I am only bringing home $800 a month and $400 of that goes to daycare alone!!

Unfortunately there was no miscalculation

I just wanted to respond to the comment about miscalculation. I may have worded this incorrectly. I bring home $800 after the $400 a month in garnishment. $400 of this goes to daycare. I have to pay rent, utilities, food, gas, etc. out of the other $400 left which is impossible! I have lookied into a lawyer as well, but unfortunately I had to sign the litigation waiver when I purchased this car. This means that I can not just go out and sue this company. I appriciate all of the feedback and hope my experience helps others to make an informed decision and stay away from this particular company.

You have misread the math.

Use the legal system

Your situation is unfortunate, but there are some things you can do. 1. I don't know how long it has been since your bankruptcy, but if it has been enough time, file again. When you file, the garnashment will stop THE DAY YOU FILE! (If you are worried about your credit, don't worry, with them garnishing your wages, you credit is still bad.) 2. File a lawsuit. In your state, a credit can not repossess unless your are 10 days late. If the manager made arrangements with you, that changes your due date. The creditor acted illegally in repossessing when they did When you file in district court, you can then ask the judge to stop the garnish. I would recommend getting an attorney if you go this route. However, there are many good attorneys who will likely take payments (less than $400 per month.) Also, you will likely qualify for legal aid, since they will consider the after garnishment wage. I hope this helps. Please let us know how it turns out.

This doesn't add up? $800 paycheck, -$400 daycare -$400 garnishment

This doesn't add up to me. If you have a child/children and you paid $400 for a car and only make $800 a month you bought a car that was way too expensive in the first place. File bankruptcy since you rent, have kids and can't get on welfare.
